MUNICIPAL LIEN FOR SEWER/WATER RATES
NOW COMES the Borough of Mechanicsburg Cumberland County,
Pennsylvania, by its attorney Lisa Marie Coyne, Esquire, and files the within
claim for charges assessed with respect to sewer and /or refuse rates
against above named owner or owners and against the hereinafter
described real estate as follows:
STATEMENT OF CLAIM
1. This claim is filed by the Borough of Mechanicsburg, a borough organized
and existing in accordance with the laws of the Commonwealth of
Pennsylvania.
2. The owner or reputed owner of the property, or party or parties
responsible or liable, for which this claim is filed is the Defendant(s).
3. The authority under which the sewer and/or refuse rates were changed
and assessed is the Act of July 18, 1935, P.L. 1286, Section 1, 53 P.S. § 2231,
as amended.
4. Plaintiff has made demands for payment for services; however,
Defendants) have not made payments for the services provided.
5. The authority under which this claim is filed is the Act of May 16, 1923
P.L. 207, Section 9, et seq., 53P.S. §7143, as amended. a`Sd/1/

' 6. A description of the property against which this claim is filed is:

7. This claim has not been the subject of any previous claim and judgment
in the Court of Common Pleas of Cumberland County for sewer and/or
refuse charges.
8. The total amount of the charges for which this claim is filed is five hundred
and fifty-four dollars and forty cents ($554.40), plus costs
and reasonable attorney's fees.
9. The time period for which these charges are filed is January 1, 2014 to
December 31, 2014 on Sewer and Refuse Account 3177-0.
WHEREFORE, Claimant requests that a Municipal Lien be entered in
its favor and against the Defendants in the amount of five hundred and
fifty-four dollars and forty cents ($554.40), plus cost and reasonable attorney's
fees.

WHEREAS, Albert P. Amicucci was vested in his lifetime with premises
hereinafter described, situate in Cumberland County, Pennsylvania; and
WHEREAS, the said Albert P. Amicucci died September 25, 2011; and
WHEREAS, Frank A. Amicucci qualified as Executor of the Estate of Albert P.
Amicucci and the Cumberland County Register of Wills assigned the Estate No. 21-
11-1067
NOW THIS INDENTURE WITNESSETH, that the said Grantor, for and in
consideration of the sum of SEVENTY-EIGHT THOUSAND FIVE HUNDRED-.- - - -
($78,500.00) DOLLARS, lawful money of the United States, to him in hand paid by
the said Grantee, at and before the sealing and deliver hereof, the receipt whereof is
hereby acknowledged, has granted, bargained, sold, aliened, released and confirmed,
and by these presents, and does grant, bargain, sell, alien, release and confirm unto
the said Grantee, his heirs and assigns,
ALL THAT CERTAIN piece or parcel of land situate in the Borough of
Mechanicsburg, Cumberland County, Pennsylvania, bounded and described as
follows:
BEGINNING at a point at corner of Lot now or formerly of Mrs. C. K. Spahr,
in the center line of East Portland Street, said point being located a distance of
three hundred fifty (350) feet, more or less, East of the center line of North Market
Street; thence extending along the line of said Lot now or formerly of Mrs. C. K.
Spahr, North 02 degrees 00 minutes West, a distance of two hundred (200) feet to a
point in a public alley; thence along said alley, North 88 degrees 35 minutes East,
thirty (30) feet to a point in the line of land formerly of Solomon Byers, now or
formerly of 0. H. May; thence along the line of said land now or formerly of O. H.
May, South 02 degrees 00 minutes East, a distance of two hundred (200) feet to a
point in the center line of East Portland Street, aforesaid; thence along the center
line of East Portland Street, South 88 degrees 35 minutes West, a distance of thirty
(30) feet to the point and place of BEGINNING.
HAVING THEREON ERECTED a two story frame dwelling house and frame
garage building, known and numbered as 17 East Portland Street, Mechanicsburg,
Pennsylvania.
BEING the same premises which Dolores C. Milletics, Executrix of the Estate
of Foster K. Lucas, by Deed dated August 28, 1964 and recorded in Cumberland
County Deed Book I21, Page. 345, granted and conveyed unto Albert P. Amicucci
and Frances Amicucci, his wife.
Frances Amicucci died November 17, 2004 whereupon sole title became vested
in Albert P. Amicucci by virtue of the doctrine of survivorship incident to tenancy by
the entirety.
TOGETHER with all and singular the building and improvements, ways,
waters, watercourses, rights, liberties, privileges, hereditaments and appurtenances
whatsoever thereunto belonging, or in anywise appertaining, and the reversions and
remainders, rents, issues and profits thereof, and also, all the estate, right, title,
interest, use, trust, property, possession, claim and demand whatsoever, in law,
equity or otherwise howsoever, of, in, to or out of the same:
TO HAVE AND TO HOLD, the said hereditaments and premises hereby
granted and released, or mentioned and intended so to be, with the appurtenances,
unto the said Grantee, his heirs and assigns, to and for the only proper use and
behoof of the said Grantee, his heirs and assigns, forever.
And the said Grantor does covenant, promise and agree to and with the said
Grantee, his heirs and assigns, by these presents, that the said Grantor has not done,
committed, or knowingly or willingly suffered to be done or committed, any act,
matter or thing whatsoever whereby the premises hereby granted, or any part
thereof, is, are, shall or may be impeached, charged or encumbered, in title, charge,
estate, or otherwise howsoever.
