Barbara McK. Mumma and Lisa M. Morgan,. Executors of
the Will of Robert M. Mumma, deceased, plaintiffs in the above
action, file the following Reply to the New Matter of Barbara
M. McClure, defendant in the above action, in accordance with
the numbered paragraphs thereof:
1. The allegations set forth in Paragraph 28
regarding jurisdiction of the Orphans' Court and the
requirements for a cause of action for declaratory relief are

conclusions of law to which no responsive pleading is
required.
2. The allegations of Paragraph 29 are denied
insofar as the defendant maintains that the dispute outlined in
plaintiffs' complaint does not arise under the will of the
decedent. Plaintiffs' averment in the Complaint, that the
dispute involves an interpretation of Article THIRTEENTH of the
will of the decedent which is properly subject to adjudication
by this Court, stands for itself. Defendant's other statements
in Paragraph 29, in which the defendant affirms that she will
participate in these proceedings to the extent required to
secure an accommodation of the interests of the parties, do not
require a responsive pleading.
