MEMORANDUM OPINION AND ORDER OF COURT
On June 20th, 1989, Robert M, Mumma II filed a rule to
show cause why he should not be permitted to withdraw the
disclaimer he filed in the Office of the Register of Wills of
Cumberland County on or about January 12th, 1987,
The rule was issued, and an answer to the rule has
been filed by the estate of Robert M, Mumma, deceased, and
Robert M, Frey, guardian ad litem for the minor children of
Robert M, Mumma II,
A hearing was set for today, and at the hearing the
Court did not believe that any type of testimony was needed to
make a proper decision on the petition, and the Court now
directs counsel for the Petitioner to file a brief with the
Court within 30 days from today setting forth the law, and the
Court has directed Robert M, Frey, counsel for the children, to
file a brief with the Court within fifteen days after counsel
for the Petitioner has submitted their brief,

Upon receiving both briefs, the Court at that time
will decide whether or not the Court wishes to hear oral
argument or decide the case solely on briefs submitted or
whether any factual testimony may be needed before a decision
can be rendered.
As of now, the estate of Robert M. Mumma takes no
position as to whether or not Robert M. Mumma II should be
allowed to revoke his disclaimer, and, therefore, no brief is
required from the estate.
