WHEREAS, RICHARD A. KOVAL and DONNA J. KOVAL of 90 Prock Drive, H nover,
Pennsylvania, is about to execute contemporaneously herewith, a contract, with TH MAS
CONSTRUCTION of 155 Ken-Lin Drive, Carlisle, Pennsylvania, for the erection of a buildin upon
premises commonly known as 1200 SUMMIT WAY, Township Hampden, Cumberland ounty,
Pennsylvania, as set forth in the deed dated 1'Y1<~h 11 , JoQ,\ , recorded at Deed Book Q 8' , Page
j do 0 , in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically de cribed
in Exhibit" A" which is incorporated herein and attached hereto.
NOW, April 8, 2005, at the time of and immediately before the execution of the principal c ntract,
and before any authority has been given by the said Owner to the said Contractor to commence ork on
the said building, or purchase materials for the same in consideration of the making of the said ontract
with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Ow r, it is
agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any
of the materialmen or workmen or any other person for any labor, or materials purchased, or ext a labor
or materials purchased for the erection of said building, the right to file such liens being expressly aived.
WITNESS, our hands and seals the day and year aforesaid.

BEGINNING at a point on the southern right-of-way line of Summit Way that is 10 ated
at the northwestern comer ofOS-3 being the northeastern comer of Lot #1; thence, along S-3
South 00 degrees 48 minutes 16 seconds East by a distance of 58.61 feet to a point; thence, along
the lands now or formerly of Donald L . Basehore South 89 degrees] 1 minutes 44 second West
by a distance of 189.27 feet to a point; thence, along Lot #2 North 00 degrees 48 minutes 1
seconds West by a distance of 197.27 feet to a point on the southern right-of-way line of S mmit
Way (erroneously labeled on the recorded subdivision plan as North 00 degrees 45 minute 26
seconds West by a distance of ]96.98 feet); thence, along the southern right-of-way line of
Summit Way on a curve to the left with a radius of269.00 feet with an arc length of210A feet
