WHEREAS, Geoffrey W. Brownrigg and Karen P. Brownrigg of 1161 Charter Place, Cen erville,
Ohio, is about to execute contemporaneously herewith, a contract, with Thomas Construction of I 5 Ken-
Un Drive, Carlisle, Pennsylvania, for the erection of a building upon premises commonly kno as
Lot 47 Hampden Summit, Mechanicsburg, Cumberland County, Pennsylvania, as set forth in e deed
dated fl.pr./ /5, J 605 , recorded at Deed Book d (va , Page ell I () , in the Recorder' Office
for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is inco orated
herein and attached hereto.
NOW, April 15, 2005, at the time of and immediately before the execution of the
contract, and before any authority has been given by the said Owner to the said Contractor to co ence
work on the said building, or purchase materials for the same in consideration of the making of he said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by wner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, r extra
labor or materials purchased for the erection of said building, the right to file such liens being e pressly
waived.

designated as the Grantor,

GEOFFREYW. BROWNRIGG and KARENP. BROWNRIGG, husb ndand
wife, hereinafter designated as the Grantees.
WITNESSETH, that the Grantor for and in consideration of NINETY -NINE THOUS NINE
HUNDRED AND 00/100 DOLLARS ($99,900.00), lawful money of the United States of Am rica, to
the Grantor in hand well and truly paid by the Grantees, at or before the sealing and delivery f these
presents, the receipt whereof is hereby acknowledged and the Grantor being therewith fully satisfi ,does
by these presents grant, bargain, sell and convey unto the Grantees forever.
ALL THAT CERTAIN tract or parcel of land being situate in Hampden Township, Cum erland
County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point along the western right-of-way line of Skyview Court, said poi being
the southeast corner of Lot 47 as shown on the "Final Subdivision Plan for Hampden Summit - Ph e 2";
thence South 88 degrees 38 minutes 15 seconds West, a distance of 135.52 feet to a point; thenc North
01 degree 21 minutes 45 seconds West, a distance of 80.00 feet to a point; thence North 43 deg ees 40
minutes 17 seconds East, a distance of 111.66 feet to a point; thence South 46 degrees 19 min tes 43
seconds East, a distance of 111.53 feet to a point on the western right-of-way line of Skyview ourt;
thence by the said right-of-way line on a curve to the left having radius of 60.00 feet, an arc Ie gth of

53.48 feet and a chord bearing of South 24 degrees 10 minutes 23 seconds West, a distance of

containing 17,385 square feet or 0.40 acres.
BEING part of the same premises which Ray M. Souder a/k/a Ray M. Souder, Sr., d Fay E.
Souder by Deed dated July 9, 2003, and recorded July 10,2003, in the Office of the Recorder of Deeds
in and for Cumberland County, Pennsylvania, in Record Book 258, Page 224, granted and conv yed unto
F.A.S.T. Partners, L.P., a Pennsylvania Limited Partnership, the Grantor herein.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbr ces and
other matters of record or that which a physical inspection or survey of the premises would re eal.
TOGETHER with all and singular the buildings, improvements, ways, woods, waters,
watercourses, rights, liberties, privileges, hereditaments and appurtenances to the same belon ng or in
anywise appertaining; and the reversion and reversions, remainder and remainders, rents, is ues and
profits thereof, and of every part and parcel thereof; AND ALSO all the estate, right, title, inte est, use,
possession, property, claim and demand whatsoever of the Grantor both in law and in equity, , in and
to the premises herein described and every part and parcel thereof with the appurtenances. T HAVE
AND TO HOLD all and singular the premises herein described together with the hereditam nts and
appurtenances unto the Grantees and to the Grantees' proper use and benefit forever.
AND the Grantor covenants that, except as may be herein set forth, it does and will forever
specially warrant and defend the lands and premises, hereditaments and appurtenances hereby c veyed,
against the Grantor and all other persons lawfully claiming the same or to claim the same or y part
thereof, by, from or under it, them or any of them.
In all references herein to any parties, persons, entities or corporations, the use of any p rticular
gender or plural or singular number is intended to include the appropriate gender or number as the text
of the within instrument may require.
Wherever in this instrument any party shall be designated or referred to by name or eneral
reference, such designation is intended to and shall have the same effect as if the words "heirs, e utors
