LEEDY and TRACEY E. LEEDY, husband and wife, hereinafter referred to as Owner, whereby the contractor und rtook and agreed to erected and construct a single family dwelling situate in Upper Allen Township, Cumberland County, Pennsylv nia and more fully described in Exhibit "A" which is attached he eto and made a part hereof known as Lot No.3, Lindenwood Develop ent, Mechanicsburg, PA 17055. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That th said Contractor, for an in consideration of the sum of ($1. 00) ollar to Contractor in hand paid by Owner, the receipt whereof is ereby acknowledged, and the further consideration mentioned n the agreement aforesaid, for itself, himself or themselves an its, his or their subcontractors, and all parties acting thro gh or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them again t the said buildings and the lot of ground appurtenant thereto fo or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, 0 about the erection and construction of the said buildings on t e lot above described, and the said Contractor, for itself, him elf or themselves, its, his or their subcontractors and others under them, hereby expressly waive and relinquish the right t have, file, and maintain any mechanic's liens or claims against t e said buildings or any of them, and agree that this instrument, aiving the right of lien, shall be an independent covenant. Book 555, Page 806, and s amended by First Amendment to Declaration for Lindenwood, a Planned Communi ("First Amendment"), dated April 28, 1999, recorded April 28, 1999, in the Office of t e Recorder of Deeds of Cumberland County, Pennsylvania, in Misc. Book 611, Page 193, a d as amended by Second Amendment to Declaration for Lindenwood, a Planned Communi ("Second Amendment"), dated April 17 , 2002, recorded April 19, 2002, in the Office of t e Recorder of Deeds of Cumberland County, Pennsylvania, in Misc. Book 686, Page 25 1, designated in such Declaration (as amended by First Amendment and Second Amendme t) as Lot No.3 (Identifying Number), described in Section 2.2 of the Declaration (as amend d by the First Amendment and Second Amendment) and shown (and described) in Exhibit B of the Dedaration, Exbibit B-1 of the First Amendment or Exhibit C-3 of the Seco d Amendment.
