MANDERBACH, of the Borough of Lemoyne, Cumberland County, Pennsylvania, being of sound and disposing mind, memory and understanding, do hereby make, publish and declare this as and for my Last Will and Testament, hereby revoking and making void any and all Wills or Codicils at any time heretofore made by me. ARTICLE I DEBTS I direct the payment of all my legal debts and the expenses of my last illness and funeral from my Estate as soon after my death as conveniently may be done. ARTICLE II TANGIBLE PERSONAL PROPERTY I give and bequeath my motor vehicle(s), household and personal effects and other tangible personalty of like nature (not including cash or securities), together with any existing insurance thereon. unto my wife, ROSELLA MANDERBACH, provided she survives me by thirty (30) days. In the event that my wife, ROSELLA MANDERBACH, is not living on the thirty-first (31 st) day following my death, I give and bequeath the same unto those of my children who are living on the thirty-first (31 S`) day following my death, to be divided among them in as nearly equal shares as is practicable, considering their personal preferences. If there is a dispute as to the disposition of any item or items, I direct that the same shall be sold and the proceeds distributed as part of the residue of my Estate. While this request is absolute, if I leave with my Will a Letter of Instruction indicating my desire with respect to the disposition of any item or items of my tangible personal property, it shall be regarded. ARTICLE III REST, RESIDUE AND REMAINDER I give, devise and bequeath all the rest, residue and remainder of my Estate, of whatsoever and wheresoever situate, unto my wife, ROSELLA MANDERBACH, provided she survives me by thirty (30) days. If my wife, ROSELLA MANDERBACH, is not living on the thirty-first (31 St) day following my death, I give, devise and bequeath all the rest, residue and remainder of my Estate, of whatever nature and wherever situate, as follows: A. One-third (1/3) thereof unto my daughter, SHARON S. CORBIN, or her then-living issue, per stirpes, should she not be living on the thirty-first (31 St) day following my death; B. One-third (1/3) thereof unto my daughter, MARILYN J. TRESSLER, or her then-living issue, per stirpes, should she not be living on the thirty-first (31 St) day foilowing my death, and if there be a faiiure of same, tnen her share shall be distributed in accordance with Paragraphs A and C; and C. One-third (1/3) thereof unto my daughter, JiTDITH A. SEITZ, or her then- living issue, per stirpes, should she not be living on the thirty-first (31 St) day following my death. 2 ARTICLE IV ALTERNATE DISPOSITION OF REST, RESIDUE AND REMAINDER If my wife, ROSELLA MANDERBACH, is not living on the thirty-first (31St) day following my death, and I have no issue then-living, I give, devise and bequeath all the rest, residue and remainder of my Estate, of whatever nature and wherever situate, as follows: A. One-half (1/2) thereof unto my intestate heirs pursuant to 20 Pa. C.S.A. Section 2103; and B. One-half (1/2) thereof unto the intestate heirs of my wife, ROSELLA MANDERBACH, pursuant to 20 Pa. C.S.A. Section 2103. ARTICLE V DISTRIBUTION TO BENEFICIARIES UNDER THE AGE OF 25 /INCAPACITATED PERSONS Whenever my Personal Representative is directed to distribute property to or for the benefit of any beneficiary who is under (a) twenty-five years of age, or (b) a legal disability or otherwise suffers from an illness or mental or physical disability that would make distribution directly to such beneficiary inappropriate (as determined in my Personal Representative's sole discretion exercised in good faith), my Personal Representative may distribute such properly to the person who has custody of such beneficiary, may apply such property for the benefit of such beneficiary, may distribute such property to a custodian for such beneficiary, whether then serving or selected and appointed by my Personal Representative (including my Personal Representative), under any applicable Uniform Transfers to Minors Act— or Uniform Gifts to Minors Act, or may distribute such property directly to such beneficiary without liability on the part of my Personal Representative to 3 l see to the application of such property. This provision shall not in any way operate to suspend such beneficiary's absolute ownership of such property or to prevent the absolute vesting thereof in such beneficiary.
