Kincher, Deceased, E14-54, Probate Documents Dear Attorney Grayson: Enclosed please find the Estate Information sheet, Petition for Grant of Letters, three renunciation forms, death certificate and a check to probate the Estate of Kenneth P. Kincher. The estate is being opened at this time in order for St. John's Lutheran Church to cash US Savings Bonds that Mr. Kincher purchased and named the beneficiary at death to be St. John's Lutheran Church. Unbeknownst to Mr. Kincher and whomever he purchased the bonds from, the Treasury does not allow organizations to be a pay on death beneficiary hence the need to probate the estate. Therefore, even though we believe the pay on death designation creates a "constructive trust"to benefit the church, the-U.S. Department of Treasury requires an estate to be opened to disperse the bonds. All known family have declined to act and therefore the church, as beneficiary under the constructive trust arrangement, is volunteering to act as Administrator. To our knowledge, Mr. Kincher died intestate. We are having the representative chosen by the church sworn in as Administrator here in Lehigh County. However, we need to submit for probate in Cumberland County due to the death certificate designating such as his last county of residence. Page Two Estate of Kenneth P.
