Suite 30Q Ilcrshcy, PA 17033. 2, �fhis Court hasju�isdiction over this matter pursuant to 20 Pa.C.S.A. § 711(10) in that diis mattcr involves the administration and distribution of the real and personnl pmpcny of the estate of an incapacitated person. 3. The Incapacitatcd Pcrson is Knlhlcen M. Knisely ("Mrs. Knisely") who resides nt 23 W. Lawn Circle, Wormlcysburg, PA 17043. 4. By Order of this Cou�t dated Vovembcr 15,2012, a copy of which is attachcd heretu as "Exhibit A" and incorporated herein by reference, Petitioner was eppoinred plenary 1 �vnnaaa guardian ol the estate of Mrs. Knisely. AdditionalLy, under the said O�der of Court. James G. Knisely and Barbara Knisely weie appointed co-guacdians oCthe peison oFMcs Knisely. 5. Mrs. Knisely is 82 years of age, having becn born on Fcbruary I 1, 1933. 6. Mattcrs involving Mrs. Knisely's person and estace have bcen thc subject of numerous petitions filed with this Court resulting in various Orders oCCourt issued by the Coun, and such pmecdural hisrory will not be reiter¢ted in this Petition. 7. Mes. Knisety's average ongoing monthly income mtals appcorimatcly $I S,R98. consisting of the tollowing: (a) $1,120— SocixlSecurity; (b) $864—distributio�s from trust of late husband: (c) $73,166—guardinnshipfundsmanagcdbyPetitioner. (d) 5270—dividends from Cadisle Companics stock; and (e) $478 - required minimum distributions from IRA. 8. Mra Knisely's primary assets mtal approximatcly 56,694,500. consisting oCthc fol lowing: (a) $6,21�.000 million—gunrdianship account managed by Pctitioncr. (b) $5,000 to �10.000 - �9R1' chccking nccount; (c) $99,000 —IRA; and (d) $373,000—CarlisleCompaniesstock. 9. Addi[ionally, (1) Mrs Knisely's homc is owned by a Qualified Personal Residence Tmst(QPRI�; (2) she previoiisly established a Declaration oCTrust, dated Decembcr 28, 2012, for the benelit of her children, which 'Lrust is administered by Petitioner and has n currmit balance of 54,385,000; and (3) she previously transferred ownership of a life insuranee 2 policy to he� children. which policy has a cash value of approximatcic $1 J million a�id u face amount oC$3 miilion. Fxnenditures of Prineinal for Monthlv Exnenses 10. Mes. Knisely s current and ongoing living expenses total approximately $16.000.00 per manth. I L Additionally, Mrs. Knisely gocs on periodic tripsh�acations and inw�s othei sporadic expenscs for entenainment, ete., which espenses are over and abovc the aforementioned regular monthly expenses ol approximately $16,000.00. These additional expenses total upwards o(�25.000 per yeaz. 12. Petitioner also noles that although Mrs Knisely's ineome is sig�iticant. her Social Securily income of opproximxtely $1,120 per month is the only fised, regular, and certain income Cmm montli to month, and the balar.ce of her income is subject [o great �luctuation, as itemized beloH�, resulting in drastic income shortages in several months during the ycar: a. The guardianship income has Fluctuated from month to month over the Iast 12 months from a low o($6,519 to a high of$25,741, and so the actual income from the guardianship account availeble for Pctitioner ro espend Cor Vlrs. Knisely's benelit in any givcn month may be lowcr (as low as $9,000) or higher than the xbovc-referenced �nonthly amoim[. b. Mrs. Knisely"s incomc from thc trust of hcr latc husbund fluctualcs from upproximtttclp S7R3 per month to $945 per month. c. Mcs. Knisely's dividend income Irom he� Carlisle Companies stock is paid quarterly and also flucwates frmn quartec to quarter. 3 d. �fhc required minimum dis'tribution from Mrs. Knisely's IRA is paid out annually (rathcr than monthly) each Pebruap�. 13. "fhus, as demonstratcd by the aforemcntioned income itemization, :Vtrs Kniscly's act�al availablc i�come in any givcn month can be as low as approximatcly $10,90Q thus leaving an income shortage of approximately $5,000 per month for typical expcnses in any given month during the year, which would not includc any additiunal income shortagc foc additional expcnscs th2t Mrs. Knis-cly might incur thmughout the year fo� entertainment, recrcation. trips, etc. 74, 20 Pa.C.S.A. § �536(a) provides, in parT. I5. Whercas Vlrs. Knisely, because ofvarying monthly income, often laeks sufficienl iocome to pay for her monthly expens'es, and Petitioner regularly is constreioed to defer pttyment of various monthly cxpenses until additional income is generated in the guaxdianship account, Pctitioncr seeks appmval from [his Court, pursuant to 20 Pa.C.S.A. § 5536(a), to expend Mrs. Kniscly's- principal hercafter as needed on an ongoing monthly basis, no[ to exceed an aggregate amount of 560,000 per ycar, as is necessary to pay vlrs. Knisely's ongoing monthly expcnses and uny and all othcr monthly expcnses incurred related to Mrs. Knisely's heal[h, support, maintrnnnce. and wclfare. including travcl, entcrtuinment, and recreation eapcnses. 4 Exnendi[ures of Princinal for Charitable Giving 16. I-listorically, Mrs Knisely and her late husband have maintained a pattern of making various and substantial gifts to various charitable oxganivations. 17. Por cxamplc, in reviewing past financinl and [ax records, Petitioncr has learned that Ylrs Knisely and hec lare husband gave 513R.000 to Gettysburg College in 1982. Also, Pctitioner has been provided by Mrs K�isd}''s CPA �+'ith an itemization oCcheritablc gifts from 1996 through 2013 ranging from nominal amounts to as high as approximately $12,000 per year to various charitable organizations. 18. At the present time, through discussions with Mrs. Knisely and her childreq Mrs. Knisely has espressed a desire to Petitioner to continue to engage in eharitable giRing each year to various o�gani�ations. such as hee local YMCA, police dcpartmcnt, fire department and library. SpeciCically, Mrs. Knisely has expresscd a desire to make charitable giIls in the rangc of approximately $3Q000 per year and xs high as $50,000 per ycar, some of which she desires ro givc by m°ay oFdonating apprecieted stock to vxrious chariteblc or�anizations. 19. 30 Pa.GS.A. § 5536(a) pmvides, in part: �'The cuwt. lor cuuse sho�vn anJ u'ith only such notice as it considers lppropriate in the circumstanecs, mxy authorize or dinet the paymcnl or upplication of any or all of the income or principul of the estate of�n ine�paci[ated person for . . . those tor �ehom he was making such provision be(ore his ineapacit}�." 2U. 20 Pa.C.S.A. § 5536(b) provides, in pan: �`I�he court, upon petitiun and o'ith noticc «i all partics in intcrest 2nd for goo� cause shoun, shall havc the power tu substitutc its judgment �or that of the inenpacitated peison w�ith respoct to the es�ate and aff�irs uf thc Ineapncimiarl person lor tha bcnefii oCthe incepacitalcd person . . . and cheu�ilics in ��iiieh he �azs 5 interesmd. Knisely is charitably inclined, has a history of making eharitable giCls, fmds greut personal satisfactio� in making gilts to various local charitics, and desires to continuc to engage in charitablc giving Pctitioner seeks- approval from this Court, purs'iinnt to 20 Pa.C.S.A. § 5536(a) and (b), ro expend Mra Knisely s principal hereafter to make such eharitable giRs- as Yetitioner, in Petitioner's disemtion and upon discussion with ¢nd request by Mrs. Knisety nnd hec children, may so determi�e. with sueh charitable gifting to not exceed the sum of$50.000 per ycar. 23. Petitioncr would note for the Court that the Court. by Pinal Decrce of January 5, 2015 has authorized Petitioncr to pay the annual premiums on a life insu�anec policy that Mrs. Kniscly t�ansferred to hcr children in [he past, with such "neP' premiunts totaling t�pproximately 550,000 per ycar if Petitioner elccts to utilize accrued dividcnds in the policy to apply ro the annual premiums. 24. I3ased upon an assumed annual income in the guurdianship aceount of$I 58,000 pex year, nnd Petitimier expending principal oCappmxima[ely$35,000 pex year for annual IiPc insurznce prcmi�ms; up to S50,000 per year for charitable gifts, and up to 560,000 per year in additional principal expendituccs fox monthly eapenscs of Mrs. Knisely, Petitioncr believes that Vlrs. Knisely's current assets would be sisficient to cover the aforcmentioned principal espenditures for the balance of Mrs. Knisely's life expcctancy (recognizing that the nced to 6 espend p�incipal evenmally will inc�ease as incomc in the account is �educed by virtuc a decreasing principal balance).
