A contingent charitable gift is made to Polyclinic Medical Center, 2601 North 3rd Street, Harrisburg, Pennsylvania under section EIGHTH of the decedent's will. section SEVENTH establishes a Marital Trust for the benefit of decedent's wife. At her death, the balance of principal is to be paid to decedent's issue, per stirpes. section EIGHTH provides that if the decedent's wife survives him, his residuary estate is to be distributed to a trust for her benefit. At her death, or at his death if she does not survive him, the balance of the residuary estate is to be paid to decedent's issue, per stirpes. If no issue survive the survivor of decedent and his wife, the remaining assets of both trusts, or of the residuary estate, are to be paid to the above-named charitable beneficiary.
