IN RE: APPEAL FROM PROBATE
ORDER OF COURT
AND NOW, this 20t" day of February 2015, following several days of hearings, it
is readily understood why members of the Recht family brought this action; however,
closure will not occur within this will contest, for that the court offers the family
condolences. It is right for the Recht's to feel that for want of a phone call, letter, or
other information sharing process that they were denied an opportunity to make their
peace with their Mother. That denial was wrong but is not an issue in this will contest.
Decedent has many foibles; however, the threshold for testamentary intellect is not
voided by lifelong eccentricity.
It is found that E. Jeanne (Hogue) Recht had testamentary capacity; therefore,
this Citation previously issued to Respondent is DISMISSED. The Decree of the
Register of Wills admitting to probate the instrument of August 3, 2011 is hereby
AFFIRMED.
