NOTE
Curtis T. Reese. ("Borrower"), of Cumberland County, Pennsylvania, he by promises
to pay to Raymond E. Diehl and Genevieve A. Diehl, husband and wife, and D nald E.
Diehl and Suzanne Diehl, husband and wife, ("Holder") of Carlisle, Cumberlan County,
Pennsylvania their heirs, successors and assigns, Forty-five Thousand, Nine Hun red Dollars
($45,900.00) by paying Forty-five Thousand, Nine Hundred Dollars ($45,900.0 ) upon the
sale and settlement, or rental of the residence to be built on Lot 28 Nicholas anor,
Dickinson Township, Cumberland County, Pennsylvania but in no event late than one (1)
year from the date of this Note.
In the event of default by Borrower, interest shall accrue and be payable at e rate of
Wall Street Journal Prime plus three (3%) percent.
Notice, demand, presentment, or protest is expressly waived by Borrower. Borrower
shall have the right to prepay all or any part of the principal amount of this Note at y time or
from time to time without premium or penalty.
IN ADDITION, IN THE EVENT OF THE DEFAULT IN THE PAYMENT D E
HEREUNDER, BORROWER DOES HEREBY AUTHORIZE AND EMPO ER THE
PROTHONOTARY OR ANY ATTORNEY OF ANY COURT OF RECORD F
PENNSYL VANIA OR ELSEWHERE TO APPEAR FOR AND ENTER JUD MENT
AGAINST BORROWER FOR THE ABOVE SUM, WITH OR WITHOUT
DECLARATION, WITH COSTS OF SUIT, RELEASE OF ERRORS, WITH
OF EXECUTION, AND WITH 15 PERCENT ADDED FOR COLLECTION
BORROWER HEREBY AGREES NOT TO MAKE ANY MOTION OR AN
APPLICATION WHATSOEVER TO ANY COURT FOR AN INQUlSITIO ON ANY
REAL ESTATE THAT MAY BE LEVIED UPON TO COLLECT THE AFO ESAID
SUM, AND BORROWER VOLUNTARILY CONDEMNS SAME, AND AUT ORIZE
THE PROTHONOTARY TO ENTER SAID VOLUNTARY CONDEMNATI N UPON
THE WRIT OF EXECUTION. BORROWER FURTHER AGREES THAT NY
PROPERTY, REAL PERSONAL OR MIXED MAY BE SOLD THROUGH WRIT OF
EXECUTION AND FURTHER HEREBY WAIVES AND RELEASES ALL ELIEF
FROM ANY AND ALL APPRAISEMENTS, STAY OR EXEMPTION OF A Y STATE
NOW IN FORCE OR WHICH ARE PASSED HEREAFTER.
NO SINGLE EXERCISE OF THE FOREGOING POWER TO CONFESS J
SHALL BE DEEMED TO EXHAUST THE POWER WHETHER OR NOT NY SUCH
EXERCISE SHALL BE HELD BY ANY COURT TO BE VALID, VOIDABL ,OR
VOID, BUT HT EPOWER SHALL CONTINUE UNDIMINISHED AND IT A Y BE
EXERCISED FROM TIME TO TIME AS OFTEN AS THE HOLDER HE OF SHALL
ELECT, UNTIL SUCH TIME AS THE HOLDER HEREOF SHALL HAVE ECEIVED
PAYMENT IN FULL OF ALL AMOUNTS OWING HEREUNDER, TOGET ER WITH
COSTS.
