consideration of the PETITION TO AUTHORIZE THE DISTRIBUTION OF PROPERTY
BELONGING TO MARY C. PELAIA, it is hereby ordered and decreed as follows:
A. In accordance with the provisions of 20 Pa. C.S. § 5536 (b); and with consideration to 55
Pa. C.S. § 178.104(e)(1)(iv), Donald P. Pelaia, as Guardian of the Estafe of Mary C.
Pelaia, shall convey by recordable deed the title to the property located at 116 Littleton
Drive in Hanover, Pennsylvania from Mary C. Pelaia, who is the widow of Fred A.
Pelaia, to Donald P. Pelaia. Said property is identified as Tax Parcel #44-000-14-008500-
00000 as presently recorded in Deed Book 81-0 Page 809 of the Recorder of Deeds of
York County, Pennsylvania. This order shall be issued in a separate order (herein
attached), separate and distinct from the other items set forth herein, in order to facilitate
ease of recording at the York County Recorder of Deeds.
B. In accordance with 20 Pa. C.S. § 5537, Donald P. Pelaia, as Guardian of the Estate of
Mary C. Pelaia, may create an irrevocable funeral trust (IFT) in the amount of$11,800 in
cooperation with a licensed funeral director for the eventual funeral services and burial of
Mary C. Pelaia.

C. Donald P. Pelaia, as Guardian of the Estate of Mary C. Pelaia, shall pay forty six
thousand eight hundred and forty one dollars and forty three cents ($46,841.43) from the
funds of Mary C. Pelaia to Donald P. Pelaia for payments made for the funeral of Fred A.
Pelaia, legal fees associated with the guardianship petition and hearing for Mary C.
Pelaia, for the care of Mary C. Pelaia, and for minimum necessary expenses to
responsibly maintain her real property, when the funds of Mary C. Pelaia were
inaccessible between the time of the death of Fred A. Pelaia on April 30, 2014 and this
Court's appointment of Donald P. Pelaia as Plenary Guardian of the Person and Estate of
Mary C. Pelaia.
D. The Court finds that this re-payment of forty six thousand eight hundred and forty one
dollars and forty three cents ($46,841.43) is not a gratuitous or uncompensated transfer of
funds, but is a repayment of funds loaned to Mary C. Pelaia in reasonable expectation of
being reimbursed from the funds of Mary C. Pelaia.
E. This Order shall be docketed and filed in the Office of the Clerk of the Orphans' Court
and Certified copies may be made thereof from time to time as may be needed.
