AND NOW comes Ihe Commonwealth of Yennsylvania, by its Attomey (�ieneral,
Kathleen G. Kane, acting in he� capaciry as parens patriae, [o request tha[ this Hono�able Court
to order an accounting of the estate's administration; remove the execu[rix and appoi�t an
administrator d/b/n/c/t/a; surcharge [he Executrix for improper disbursement; in the altemative
surchazge the Executrix for undue i�flue�ce; and, issue Citation to Kazl Romminger to show
cause why he should no[reimburse the Es[ace and in suppoR avers:
1. Petitioner is the Commonwealth of Pen�sylvania, Office of Attomey Geneial,
with relevan[Offices at Strawberry Squaze, Harrisburg Pennsylvania, 17120.
2. Respondent is Lynn M. Walter, Executrix of the above captioned estate, who
resides at 40 Greenmont Drive, Enola, PA, 17015, who received Letters Testamentary as
advertised in the Cumbedand Law 7oumal on or abou[June 17, 2011.
3. Respondent is Kazl Rommingeq a former attomey who represented Respondent
Lynn Walter, Respondent Romminger formerly practiced law at 155 South Hanover Stree[,
Cazlisle, PA 17073.
4. Upon information and belief, Decedent passed on May 16, 2011, leaving a will,
attached hereto as Exhibit"A,"that leaves:

� a. All of DecedenYs gold, silver, coins and ingots to the National Military
Famity Association, and
b. The residue ro Bethesda Mission and the Salvation Army.
5. Because of the chazitable gifts, the Attomey General is an interested par[y with
standing to seek citation.
6. Pursuant to Pa. O.C.R. No. 5.6 the estate should have provided notice to the
Attomey General; however, the Estate provided no notice.
7. The Commonweal[h started the instant ]itigation by Petition for Citation filed on
May 1, 2014. The Court issued Citation which was properly served upon Lynn M. Walter.
8. The Court held a status confe�ence on August 22, 2014.
9. Since then the Commonwealth further investigated the matter.
COUNTI - ACCOUNTING
10. Executrix has a duty to promptly and efficienUy administer the estate, wind up [he
decedenYs affairs, and make dishibution to the beneficiaries.
11. Given the date of DecedenYs passing and the lack of approp�iate follow uq the
Commonweal[h has los[confidence in the Estate and requcs[s an accounting.
12. Moreover, Respondent Execu[rix was formerly represented by Karl Romminger
nnd that circumstance adds ro the present need to account.
WHEREFORE, the Commonwealth requests that this Honorable Court issue citation to
Lynn Walter, Execulrix, to show cause why she should not account.
COUNT II—REMOVAL OF EXECUTRIX
13. Pazagraphs 1 through 12 aze hereby incorporated as if stated fully.
14. The Commonweal[h is withou[ knowledge of any progress in [he adminisVation
of the Estate oc protection of the beneficiazies' inte�ests by the Executrix since the original
Citation.
15. The Execuhix has produced a draft accounting which is unacceptable ro the
Commonwealth.
16. The Cour[ can remove a personal representative who is wasting oc mismanaging
the estate or has failed to perform any duty imposed by law. 20 Pa. C.S. §3182(1).
17. The Cour[ ca� remove a personal representative when for any reason the interests
of the estate aze likely to bejeopazdized by her continuation in office. 20 Pa. C.S. §3182(5).
18. The Executrix is wasting and/or mismanaging the estate by her failure to
imestigate and prosecute claims against her former attomey Kazl Romminger.
19. As par[ of the duTy [o marshal the asse[s of the Estate, the Exewtrix has a dury [o
inves[igate claims on behalf of the esta[e.
20. The interests of the estate aze jeopazdized by the continued service of this
Executrix in that she will apparently not investigate cleims against Kazl Romminger and against
herself.
21. The Exew[rix has an irreconcilable conflict of i�terest arising from her wrongful
distribution of Estate bank accoun[ funds to herself and derogation of the duty to investigate a�d
prosecute claims against herself war�an[s removal.
WHEREFORE, the Commonwealth respectfully requests tha[ this Court remove Lynn
M. Walter as Execuhix and appoint an Administrator d/b/n/c/Ua.
COUNTIII - SURCHARGE
22. Pazagraphs 1 through 21 aze incorporated as if stated fully.
23. Upon information and belief, [he Execu[rix levied a commission of$20,147.12.
24. Claim is made for reimbursement of the Executrix commission paid in the amou�t
of$2Q147.12.
25. Upon informa[ion and belief, [he Exewtrix wrongfully took possession of bank
accounts in the amount of$206,049.02; claim is made fo�that amoun[.
26. Upon infomiation and belief, the Execu[rix's attomey, Kazl Romminger,
misappropiiated $209,69734 from the Estate.
27. The Executrix is [he one who steps in the shoes of the Testator and has the duties
to administer the estate and safeguazd its assets.
28. The Execuhix breached the duty safeguazd[he Es[a[e's assets.
WHEREFORE,the Commonwealth respectfully reques[s Ihat this Cour[ surchazge Lynn
M. Walter $456,040.60.
COUNT IV—UNDUE IIYFLUENCE IN THE ALTERNATIVE
29. Pazagraphs 1 through 28 aze incorporated as if sta[ed fully.
30. As mentioned supra, Lynn M. Wal[er was named executrix of DecedenPs Estate.
31. In that position, Ms. Wal[er ocwpied a space as a close confidential relation.
32. On or about May 14, 201I, Decedent allegedly gifted $206,049.02 to Lynn M.
Walter. See attached Exhibit"B" 12EV 1500 at Schedule G.
� 33. Because Lynn M. Walter occupied [he position of a close, confidential relation
and she received an inter vivos gift, and because this claim has been made, the fiduciary now
must prove that the transfer lacked fraud and was fair and equitable. Fiumaza v. Fiumaza, 285,
Pa. Super. 340, 349, 247 A.2d 667, 671 Q981)("Thecef'oce, bnce a fiduciary oc confidential
relationship is shown to exist,the burden is shifted to the person who is in such relationship, ... to
prove absence of fraud, and that the transaction was faic and equitable."').
34. If Lynn M. Waltec cannot show that[he transaction lacked fraud and was fair and
equitable, then the alleged gift must be found to be the product of undue influeuce and voided by
this Cour[.
WHE1tEFORE, the Commonwealth, in the altemative to Count III, respectfully requests
that this Hono�able Court issue citation to Executcix Lynn M. Waltei to show cause why the
alleged gift should not be voided as the product of undue inFluence.
COUNT IV—CITATION AGAINST KARL ROMMINGER
35. Pazagraphs 1 through 34, and al] pazagraphs of the Petition for Citation £led o�
May l, 2014, and attached as Exhibi["A," aze incorporated as if stated fully herein.
36. Upon information and belief, Kazl Romminger misappropria[ed funds from the
Estate in the amount of$209,69734.
37. Moreover, Mc Romminger levied an attomey fee of $2Q147.12 against the
Estate.
38. The attomey fee was not owing because (1) Mr. Romminger did not eazn it and
(2) Mr. Romminger's perfidy prohibits the lery of a fee.
WHEREFORE, [he Commonwealth respectfully requests, in the altemative to full
surcharge of the Execuhix,tha[this Honorable Court surchazge Karl Romminger$229,844.46.
