CITATION WITH NOTICE �
A petition has been filed with the Court to have you declazed an Incapacitated Person. If the
Court finds you to be an Incapacitated Person, your cights will be affected, including youc right to
manage money and property and to make decisions. A copy of the petition which has been filed by the
Qctitionec Diane Shunk[hroueh her attornev Andcew H Shaw is attached.
You aze hereby ordcred to appear at a heacing to be held in Court Room No. 4 Cumberland
County Courthouse, Cadisle, Pennsylvania, on November 4 ,2008 at I1_00 A.M. to tell the
Coart why i[ should �ot find yo�to be an ineapxcita[ed Pecson and appoint a Guacdian to aet on your
behalf.
To be an i�capacitated Person means that you aze not able to receive and
efPoctively evaluate information and communicate decisions and that you are unable to
manage your money and/or other property, or to make necessary decisions about where
you will live, what medical care you will get, or how your moncy will be spent.
At the hearing, you have the right to appear, to be represen[ed by an attomey, and
to request a jury triaL If you do not have a� attorney, you have the right to reques[the
Cou�t to appoint an attorney to represent you arid to havc the attorney's fees paid for you
if you cannot afford to pay them yoursel£ You also have the �ight to requcst that the
Court order that an independent evaluation as [o your alleged incapacity.
If the Court decides that you am an Incapacitated person, the Court may appoint a
Guardian for��ou, based on the nature of any condition or disability and your capacity to
fN
make and communicate decisio�s. The Guardian will be of your person and/or your
money and other property and will have either]imi[ed oc full powe�s to act for you.
If the cour[finds you are totally incapacitated, youc Iegal rights will be affecled
and you will not be able to make a cont�act or gift of your mo�ey or other property. If
the court finds that you are partially incapacitated, your legal rights will also be limited as
directed by the Couct.
If you do oot appeac at thc hearing (either in person or by an attomey representiug you)
the court will still hold the hcaring in you� absence a may appoint the Cuardian cequested.
