MOTION TO RECONSIDER COURT ORDER
NOW COMES,Robert] Howard, representing himself,reques[ing the Court to reconsider, in
part,its previous Order dated February 9, 2015. At issue is the Court's statement in items numbers 4 and
5 where the CouR suggests it will detertnine George W. Howard's designated beneficia[ies for the
a�nui[ies held by American EquiTy Investment Life Insurance Company. The Court may be unaware tha[
an Intetpleader has been filed in U.S. District Court for the Middle Distnct of Pennsylvania by
American Equity Inveshnent Life Insurance Company. The Intetpleader states that the U.S. Distnct
Court for[he Middle of Pennsylvania has jurisdiction in this matter.
We agree with America� Equiry Investment Life Insurance Company and submit that the
azu�uities in question are u�der thejurisdiction of the U.S. District Court of the Middle of Pennsylvania.
We reques[that the references to the beneficiaries ofthe annuities be removed from this Honorable

IT IS HEREBY ORDERED AND DIRECTED that:
1. The PetiGon to Wi[hdrew by Mark Mateya, Esquire, as legal counsel ot Robert
Howard and Dennis Howard is GRANTED.
2. The Petition for the Enlargement of Time is GRANTED in part. Robert
Howard and Dennia Howard are granted an eMension of time to complete discavery
untll the close of business, Frday, March 20, 2015.
3. The Motian in Limine filed by RobeR Su�eld is GRANTED in that Robert
Howard and Dennis Howard are prohibited from entering into evidence any verbal
statements or actions of the Deceased George Howard. Counsel must make objections
to any evidence oifered at the time of the hearing when the evidence is offered.
4. The Court finds thal Robert Howard and Dennis Howard through their lagal
counsel had agreed to settle their objections to Probate of the Will of George Howard as
well as the American Mnuity Ben�ciary Designations of George Howard. Legal fees
are awarded to Ivo V. Orio, III, Esquire, and Marcus A. McKnight, III, Esquire, for the
Hme required to prepare releases and return lhe Iitigation to its present status following
the Agreement to Setlle by Robert and Dennis Howard. The amount of fees payable by
Robert Howard and Dennis Howard are as follows: �
a. To Ivo V. Otto, III, Esquire, Attomey for the Estate of
Gearge Howard the sum of Eight Hundred Sixty Five and
no/100 ($865.00) Dollars.
b. To Marous A. McKnight, III, Esquire, on behalf of Robert
Sufield the sum of One Thousand Eight Hundred Thirty Seven Dollars
and fifly cents (51,837.50)with costs of$30.00.
ToWI Counsei Fees and Coab 52,702.50 payable in Thlrty(30)days from
the date of thia Order of Court by Robert Howard and Dennis Howard.
5. A headng to decide the objections by Robert Howard and Dennis HowarcJ to
the Probate of the Will of George W. Howard and to the American Annuity Beneficiary

COMPLAINT FOR INTERPLEADER
Plaintiff American Equity Investme�t Life Insurance Company ("Americac�
Equity") files this Complaint for [nterpleader, stating as follows:
PARTIES AND INTERESTED PERSONS
1. American Fquity is a company that sells annuity contracts to
co�sumers. Its principal place of business is 6000 Westown Parkway, West Des
Moines, IA 50266.
2. The late George and Edna Howard ("the Howards") purchased
annuity contracts from American Equity that give rise to this action.
3. George Howard had two sons, Robert Howard and Dennis Howard
("the Howard brothers").

42. Because the proper beneficiary has been unable to exercise any right
to annuitize either or both of Annuity Contract Nos. 179442 and 180110 by
October 15, 2014, and to receive the potential 5.25% increase in payments after
such annuitization, American Equity proposes to pay into Court the Death
Proceeds associated with both Annuity Contracts, plus 5.25%.
COUNT ONE - INTERPLEADER
43. Paragraphs 1 through 42 are inwrporated herein by reference.
44. This Honorable Court has jurisdiction, under 28 U.S.C. § 1335, over
actions in intetpleader that are filed by a plaintiff who has in "its custody or
possession money or propetty of the value of $ 500 or more" if: I) at least two
citizens of diverse states or nations claim to be entitled to that money or property;
and 2) the plaintiff pays the value of the policy into court or posts a bond for such
amount Ihat is approved by the court.
45. Venue is proper in this Honorable Court pursuant to 28 U.S.C. § 1397,
because both the incident occurred in, and at least one of the Defendanu resides in,
this Honorable Court's judicial district.
46. American Fquity is in possession of the Death Proceeds associated
with Annuity Contract Nos. 179442 and 180110, which have a value in excess of
$500.

d) fully and finally discharging and releasing American Equity from all
liability to the Defendant-Claimants arising out of the matters herein set forth,
including but not limited to any liability that could be or might be assceiated with
Annuity Contract Nos. 113775, 14'71 ]3, 174894, 179442, and 180ll 0, upon
payment of the Death Proceeds associated with Annuity Contract Nos. 179442 and
180110, plus 5.25%; into this Hononble Court; and
e) such other and further relief as this Honorable Court deems just and
proper.

Surtield is not a blood relative of ei[her George or Edna(McCommon) Howazd. He has
previously claimed to be a blood relation(their nephew).
52. A decision by American Equities stating the wrong fortn was u[ilized for a bene£ciary
change by the fa�cing party, the required hazd copy was never received,there is no identification
of who presented the documents to George for signing(John Oszustowicz or Robert Surtield or
Chris Rice)or a�umber of o[her things. I think, with proper investigation, American Equity
could determine the proper beneficiaries.
53. No comment as it is the Court's decision.
54. Accepted.
The Interpleader Statements and Exhibits you provided show a definite intent by Dad
(Ceorge)to leave his Estate to his sous; the previous Wills show the same thing. My father
info�'med me for 50 yeazs of his intent for his Estate. He didn't change his miud in his las[6
months.
