PETITION FOR SETTLEMENT OF A SMALL ESTA' ,
PURSUANT TO 20 Pa.C.S.A. SECTION 3102 --a , ,
:' -n
TO: THE HONORABLE JUDGES OF SAID COURT:
The Petition of Georgia G. Motter respectfully represents as follows:
1. Decedent, Paul D. Motter, died on October 10, 2014, a resident of West
Pennsboro Township, Cumberland County, Pennsylvania.
2. Petitioner, Georgia G. Motter, is an adult individual whose address is 402
Kerrsville Road, Carlisle, PA, 17015.
3. Petitioner, who is the widow of the Decedent, resided with Decedent at 402
Kerrsville Road, Carlisle, Cumberland County, Pennsylvania, until Decedent's
passing.
4. A copy of Decedent's Death Certificate is attached hereto and incorporated
herein as Exhibit"A".
5. At the time of Decedent's death, Decedent was seized of various assets held
jointly with Petitioner, as husband and wife, which passed to Petitioner by
operation of law.
6. Petitioner has now become aware that Decedent held one account in his
individual name at the time of his passing, said account being held at
Oppenheimer Funds Services, P.O. Box 5270, Denver, Colorado, 80217-5270,
to Account No. 00330 3300305514, a copy of a statement with a balance of

$9,217.73 at the time of Decedent's passing is attached hereto and incorporated
herein by reference as Exhibit "B".
7. Petitioner has also become aware that Quarter Horses belonging to her family
are actually owned in the name of the Decedent alone, said horses being
identified and valued on the appraisal attached hereto and incorporated herein as
Exhibit"C", at a total value of$3,600.00.
8. Subsequent to Decedent's death, Petitioner paid all fees and expenses associated
with Decedent's funeral to Ewing Brothers Funeral Home, Inc. as evidenced on
the receipt attached hereto and incorporated herein by reference as Exhibit "D",
reflecting payment by Petitioner of$9,700.00 for these services.
9. Petitioner secured a grave marker for Decedent's grave, which she paid from her
own funds, in the amount of$3,497.00.
10. Petitioner has assumed all costs associated with processing the within Petition,
including filing fees and attorney's fees in the approximate amount of
$1,000.00.
11. Petitioner is entitled to distribution of a family exemption of$3,500.00, if funds
were available to pay such to Petitioner from Decedent's estate.
12. Your Petitioner is not aware of any outstanding financial obligations of any
nature existing in Decedent's name alone or for which Decedent was solely
obligated, except a statement from Carlisle Regional Medical Center in the
amount of $1,081.37 and a statement from Cumberland Goodwill Fire and
Rescue EMS, Inc. in the amount of$89.92, which Petitioner has paid from her
own funds.
13. As such, Petitioner has paid all known debts of Decedent, all known debts
associated with the Decedent's death, and debts or fees associated with the
processing of matters related to the Decedent's estate, from her personal assets.
14. Petitioner's fees and costs so paid, exceed the value of the Oppenheimer Funds
Services fund of Decedent and the value of the Quarter Horses in Decedent's
name, by more than $2,500.00, such that Petitioner will not be able to enjoy the
benefit of a family exemption even upon receipt of these limited assets.
15. There are no additional probate assets of which Petitioner is aware which could
be included in Decedent's estate.
16. The passing of any non-probate assets has no affect upon Decedent's estate as
those assets passed directly to Petitioner as joint owner.
17. As the only assets of Decedent passed by operation of law to his wife, Petitioner
herein, and the assets that are the subject of this Petition will pass to Petitioner,
there is no Pennsylvania lnheritance Tax due from Decedent's passing.
18. To Petitioner's knowledge, there are no other parties to whom benefits from the
Decedent's passing would be due.
19. To Petitioner's knowledge, there are no individuals entitled to receive
distribution or payment of any items referenced in Section 3101 of the P.E.F.
Code, nor have any individuals received such benefits or assets referenced
therein.
20. This estate has assets, exclusive of real estate, totaling less than $50,000.00 and,
therefore, may be resolved pursuant to 20 Pa.C.S. Section 3102 through the
filing of the within Petition for Settlement of a Small Estate.
2L The children of Decedent have no claim to the assets that are the subject of this
Petition as their value is less than the debts assumed by Petitioner as Decedent's
widow and Petitioner's family exemption claim.
WHEREFORE, Petitioner requests your Honorable Court to issue an Order directed
to Oppenheimer Funds Services, P.O. Box 5270, Denver, Colorado, 80217-5270,
Ordering the release of the funds held in Decedent's name in Account No. 00330
3300305514 to Petitioner; and
Order the American Quarter Horse Association to transfer, upon the signature of
Georgia G. Motter, the horses identified and named on Exhibit "C" attached hereto and
incorporated herein.
Respectfully submitted,
r . fie, Esquire
