On March 1, 2012 Permanent Guardianship of Person and Estate for Nobue Sheller
was granted by Judge Ebert to Cumberland County Office of Aging. Following the
hearing she was admitted to Golden Living-West Shore Center where she still resides.
At time of the appointment, Ms. Sheller was diagnosed with Type 2 diabetes, high
cholesterol. HTN, psychiatric disorder with delusions. There have been no new
diagnoses. She is very verbal and ambulatory.
Nobue's negative behavior continues to escalate causing problems for staff and
residents. She is seen monthly by Chris Vargo a physician's assistant from Med
Options dealing with behavioral health issues. He reports that she continues to display
paranoia, is delusional and psychotic. She refuses to take any medications for fear she
is being poisoned. In May Nobue was taken to Holy Spirit Emergency Room by nursing
home personnel in the attempt to have an involuntary mental health commitment (302).
This was denied without any recommendations. She is often fixated on how she claims
she is being discriminated against because she is Japanese.
This agency considered the possibility of transferring her to Paxton Street Ministries in
Harrisburg. It is a personal care home that has numerous residents with mental health
issues. Even though Nobue would have her own room, have more freedom, could walk
to an Asian restaurant, and have activities with people who were ambulatory she
refused to go because she was afraid the people there would "gang" up on her.
In August, she was banned from the Home's resident council because of her behavior.
She told some residents to shut up and called other female residents who were frail and
in wheelchairs "f' bitches. Residents are intimidated by her and she is verbally abusive
to many. She will stand outside resident's room and just stare at them.
On January 21, 2015 there was a meeting held at Golden Living-West Shore with [heir
administrator, assistant executive administrator, and two social workers. Cumberland
County Aging was represented by our solicitor, Aging Care Manager Supervisor and the
Aging Care Manager that has been dealing with this situation. The staff from the Home

stressed the point that they do not teel she is Nursing Home appropriate because of her
ability to care for self, ambulate and is alert and oriented. They feel she has mental
health problems. While this agency is in agreement with them about her having mental
health problems, we have not been able to get the Mental Health System involved as
she has a dementia diagnosis. We have tried to find other placement for her, including
South Mountain Restoration Center which is a slate run nursing home for mentally ill
patients. They refused to consider her because she is already in another nursing home.
Aging's concern with a lower level of care such as a personal care facility is they could
give her a 30 day notice if her behavior were to become more than they could handle.
For Cumberland County Aging this remains a dilemma with no apparent solution.
It is the request of the Cumberland County Office of Aging that the Agency retains
Guardianship of Person and Estate of Nobue Sheller. Golden Living Center-West Shore
has demonstrated an adequate quality of care for client by managing her daily needs
and continuously monitoring her medical conditions. Mrs. Sheller's appearance is
always good. The home is managing a difficult resident.
ESTATE
On April 16, 2013 Cumberland County Aging signed a contract with Wolfe and
Company to sell Nobue's property. There are three separate lots. The house had been
condemned by North Middleton Township house because it was in deplorable condition
with large holes in the roof, weakened structure, floors satureted with water, and mold.
The structure was later razed and a lien for approximately $14,000 was put against the
sale of the house.
The appraisal by Diversified Appraisers for Nobue's property was $47,000.00. The sale
price of the property at that time was $B5,000. The property is really three separate lots
and we had to determine whether we needed to try to get them changed to one lot and
change to commercial. After talking to several professionals it was decided we should
just sell them as residential lots.
There has been no interest on this propeRy. In September 2014 we changed realtors
from Wolfe and Associa[es to Berkshire and Hathaway and reduced the price. We
reduced the price again in March 2015 to $49,900.
Following the hearing, the Agency opened a guardian checking account at M&T Bank
with funds transferred from her old checking account. Starting balance was $1194.24.
Ms. Sheller's income is currently $314 from social security and $460.80 in spousal
support. Her monthly payment to the nursing home for room and board is currently
$625.75. The Cumberland County Aging and Community Services receives $100 as a
guardianship fee for services rendered as approved by Judge Ebert in his court order
and as determined by the County Board of Assistance. She is given the $45 dollars a
month personal allowance as required Medical Assistance. In May, a payment of
$2221.28 was made to the Cumberland County Tax Claim Bureau for her 2012 taxes.
Attached are a financial summary of Nobue Sheller's income and expenses and a
spread sheet representing her checking account.
