STIPULATION AGAINST LIENS
THIS AGREEMENT made the' :)-+1-.. day of April, 2005, by and
between MARC Enterprises, Builder, of 306 North 30th Street,
Harrisburg, Pennsylvania 17109, hereinafter referred to as
Contractor, AND Kerry T, Trudgeon and Bobbi K, Trudgeon, husband
and wife, of 133 Winston Drive, Mechanicsburg, Pennsylvania
17055, hereinafter referred to as Owner, whereby the former
undertook and agreed to erect and construct a single family
residential dwelling on that certain lot of ground situate on
Ariel Court, Mechanicsburg, in Upper Allen Township, Cumberland
County, Pennsylvania, being Lot No, 2-6, Phase I, Final
Subdivision plan for Deerhaven, last revised March 2, 1998, said
plan being recorded July 31, 1998, in Plan Book 77, Page 44.
Being a part of the same premises which John M, Knaub by Deed
dated January 29, 1983 and recorded February 4, 1983 in the
Cumberland County Recorder of Deeds Office in Deed Book "B", Vol.
30, Page 136, granted and conveyed unto John M, Knaub and Janet
Knaub, his wife. The said Janet Knaub died March 26, 1995,
whereupon full and complete title to the within described real
estate became vested solely in John M. Knaub, surviving spouse.
ALSO BEING the same premises which John M. Knaub by Deed dated
March 24, 2005 and recorded in the Cumberland County Recorder of
Deeds Office in Deed Book 268, Page 577, granted and conveyed
unto Kerry T. Trudgeon and Bobbi K, Trudgeon, husband and wife,

NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for and in consideration of the sum of One ($1.00)
Dollar to him in hand paid by Owner, the receipt whereof is
hereby acknowledged, and the further consideration mentioned in
the agreement aforesaid, for themselves and their subcontractors,
and all parties acting through or under them, covenant and agree
that no mechanic's liens or claims shall be filed or maintained
by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or
materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and
construction of the said buildings on the lot above described,
and the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right
to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this
instrument, waiving the right of lien, shall be an independent
covenant.

officers and its corporate seal to be affixed hereto, the day and

the person whose name is subscribed as Owner/Contractor, and who
acknowledges himself to be the said officer of MARC Enterprises,
a corporation, and that he as such officer, being authorized to
do so, executed the foregoing statement for the purposes therein
contained by signing the name of the corporation by himself as
said officer,
