t & C Construction. ("Contractor") (or "Subcontractor"') in favor of Mike Russ and Carol S. Russ
'Owner"). Whereas, Owner is about to execute contemporaneously herewith, a contract with
ontractor for the erection of a principle residence upon a lot of land situate in Monroe Township,
~umberland County, Pennsylvania, being known as Lot No.4 West Lisburn Road, Carlisle, P A as
recorded in Cumberland County Deed Book 268, Page 1943, more fully described as follows:
hLL THAT CERTAIN unimproved tract ofland situate in Monroe Township, Cumberland County,
Pennsylvania, more particularly bounded and described pursuant to a Final Subdivision Plan for
Jcarol G. Knisely dated May 20, 2004, revised through March 18, 2005, and recorded in Cumberland
ICounty Plan Book 90, Page 100, as follows:

IBEGINNING at a railroad spike in the centerline of Lisburn Road, State Route SR 2004, at the
Inorthwest corner ofland now or formerly of Mark D. and Tricia Eckenroad, being Lot No.2 as
I shown on a subdivision plan for the grantor recorded in Plan Book 85, Page 27; thence by said land,
I South 15 degrees 56 minutes 29 seconds West 464.28 feet to an iron pin in line ofland now or
i formerly of Edwin Z. Horst; thence by said land, South 77 degrees 00 minutes 00 seconds West
1228.53 feet to an iron pin at the southeast corner of Lot No.3 as shown on the first above mentioned
i Plan; thence by Lot No.3, North 15 degrees 56 minutes 29 seconds East 576.49 feet to a railroad
spike in the centerline of Lisburn Road, State Route SR 2004; thence by the centerline of Lisburn
Road, South 73 degrees 35 minutes 35 seconds East 200.00 feet to a railroad spike in the centerline
i of Lisburn Road, the POINT AND PLACE OF BEGINNING
CONTAIN1NG 2.3892 gross acres and being known as Lot No.4 on the Final Subdivision Plan for
Carol G. Knisely.

Now, , at the time of and immediately before the execution of the construction
contract aforesaid, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same, in consideration of the
Owner making of the said contract with Contractor, and intending to be legally bound hereby, it is
agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by any
of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
