AGREEMENT EOR SALE OE REAL ESTATE
THIS AGREEMENT, made this � 3 day of /w��p�, 2019, by and
between the Estate of Francis J. Snyder, (hereinafter some[imes referred
to as "Se11er") and Justin C. Younq, (hereinafter sometimes referred
to as "Buyer") ;
W I T N E S S E T H:
�. AGAEEMENT: Seller agrees to se11 and convey and Buyer
agrees to purchase a11 that certain real property hereinafter described
upon the terms and conditions hereinafter set £orth.
2 . PAOPERTY DE3CRIPTION: The real estate whichis thesubject
of this agr=ement is all that house and lot known as 1103 Market St . ,
eorough of tiew Cumberland, Cumberland County, Pennsylvania.
3. PURCHASE PRICE: The purchase price is NINETY SEVEN
THOGSAND and NO/100 ($97, 000 .00) Dollars, payable as follows:
a. FIVE HUNDRED and NO/100 ($500.00) Dollars sha11
De paid to Se11er due upon the signing of this agreement by Se11er and
Buyer.
b. The balance of NINETY SIX THOUSAND FIVE HONDAED and

4 . DEPOSZT: The FIVE HONDRED and NO/100 ($500 . 00) Dollazs
deposit sha'_1 be held by David H. Stone, Esq. , attorney for the Seller,

is unable co convey good and marketable title as hereinafter provided,
and such concition has not been waived by the euyer, then, at the option

8 . PERSONAL PROPERTY: The sale includes whatevec electric,

neimanently affixed as attached to the oremises, all shrubbery and
landscaping.
9. TRANSFER TAXES: All real estate transfer .axes shall be
divided equally betwee❑ the Seller and tne Buyer.
10 . REAL ESTATE TAR PAORATION: All taxes levied on the real
estate sha11 be prorated as of the date of settlement, [he county and
municipal taxes being prorated on a calendar year basis, and the school
district taxes being prorated on a July 1 fiscal year basis.
11 . MONICIPAL SERVICES: A11 charqes fo: sewer rental, trash
seroice, and/or water service provided by a municipality sha11 be prorated
as oi the date o£ settlement.
12 . TITLE: At settlement, the land will be conveyed by the
Seller by fiduciary warranty deed free and clear o£ a11 liens and
encumbrances . The title is to be good and marketable and such as will
be insured by any title insurance company doing business in Pennsylvania
at its regular rates in the full amount of the purchase price. Said policy
shall contain only exceptions for easements for utility service to the
property ar.d building and use restrictions which do not interfere with
the use of the nroperty as a single family dwelling.
13 . RIS[C OF LOSS : Risk of loss from fire or oiher casualty
shall remain in the Seller until final settlement. Seller sha11 maintain
the prepercy and any personal property specifically schednled heiein in
its present condition, normal wear and tear excepted. Ia case oY fire
or other casualty pr:or to settlement, the Buyer shall have the cotion

purchase mcney is hereby waived.
18 . DEFECTS IN TITLE: In the event that any defects exist that
xould not make �he title to the oremises good and marketable as herein
ocovided, Se11er shall have a reasonable time to correct same after being
apprised thereof by the Buyer. In the event Seller is unable to correct
such defect after making a good faith effort, the agreement shall be
declared null and void and seller shall reimburse buyer for any
cancellation fee for title insurance, flood insurance or hazard insuxance,
appraisal fees, and mortgage application fees .
19 . REPRESENTATIONS: The parties aqree and the Buyers
expressly acknowledge and understand that they are buying the property
in its present condition and that the Se11er makes no representation or
warranty of any kind whatsoever with regard to the condition of the
premises or any of the components thereof, including, but not limited to,
che roof, the electzical system, the plumbing system, the heatinq system,
or any other parts of the structure or any of the improvements on the land.
The Seller makes no repzesentation or warranty with regacd to Radon or
the levels =hereof, or with respect to any type of insalation which may
have been used at any time in the property. The property is being sold
"as is" now, and at the time of settlement.
20. HOME INSPECTION: euyer, at 3uyer' s expense, may have a
proEessional home inspection company which conducts inspections in
accordance with the Standards of Practice of American Society of Home
inspectors (ASH1) give an opinicn as to whether any defects or problems
exist in the house . Should the resuits of the inspection be
�nsacisfactory in the opinion of the Buyer, �uyer may rescind this
agreement upon written notice to Seller.

22 . DEFINITIONS: Wher.ever used 'nezein the singular number

herein are for conveni2nce only and they aze not intended to indicate all
of the matter in the sections wh:ch follow them. Accordingly, they shall
have no effect whatsoever in determining the rights or obligations of the

25 . RECOADING: This agreement sha11 not be recorded in the
Office of Recorder of Deeds or in any other ofiice or place of public
record. And if Buyer sha11 record this agreement or cause or permit the
same to be recorded, Seller may, at his option elect to treat such act
as a nreach of this agreement .
20. AGREEMENT: This agreement contains the whole agreement
betwzen the parties and there are no other terms, obligations, covenants,
representations, statements or conditions, oral or otnerwise, of any kind
whatsoever and it may not be altered, amended or modified other than in
writing executed by the parties hereto.
31 . COUNTERPARTS: This agreement may be executed
simultaneously ir. one oi more counterparts, each of which shall be deemed
an original, but a11 of which together shall constitute one and the same
agreement . A signed facsimile or electronic copy sna11 also be treated
as an original .
