IN RE: PETITION TO APPOINT A GOART7IAN FOR THE ESTATE ANDFpERO
- T
ORDER OF COURT
AND NOW, this 9th day of April , 2015, upon review
of the Petition to Appoint a Guardian for the Estate and Person
of Steve E . Kintz, following a hearing, at which Mr. Kintz was
not present, his presence having been excused through the medical
testimony of his treating physician that it would potentially
place himself or others in danger to have him transported to the
courthouse, his presence is excused. Mr. Kintz was represented
in court by his court-appointed guardian ad litem, Mark F.
Bayley, Esquire, who participated in the hearing and provided the
Court with his insight .
Based on a standard of clear and convincing
evidence, the Court finds based on the testimony of Dr. Darryl
Guistwite that Mr. Kintz suffers from multiinfarct dementia, a
condition that totally impairs his capacity to receive and
evaluate information effectively and renders Mr. Kintz unable to
communicate decisions concerning management of his financial
affairs or meet the essential requirements for his physical
health and safety. Mr. Kintz is adjudicated an incapacitated
person.
Good News Consulting, Inc . , is found to be an
appropriate guardian of Che person and estate of Mr. Kintz
pursuant to statute. Good News Consulting, Inc . , shall serve
without bond, however, they must maintain their insurance at its
present level . 1 `

Based on the testimony of Dr. Guistwite,
Mr. Kintz ' s condition has a poor prognosis and must be considered
for practical purposes permanent . Based on these findings, Che
Court will enter the Final Decree as presented to it with the
provisions noted above regarding Good News Consulting, Inc . ,
maintaining its insurance and directing Good News Consulting,
Inc . , to reach out to Mr. Kintz ' s brothers as it relates to
questions of inedical treatment, which they may provide input as
they see fit .
