ESTATE OF ELEANOR U. COOLIDGE, DECEASED
REQUESTED FINDINGS OF FACT
AND NOW, comes Robert M. Frey, Attorney for the Executors of the Estate of
Eleanor U. Coolidge, deceased, and respectfully submits the following in support of the
Petition of Probate filed by the Executors:
1. Robert M. Frey and Eleanor U. Coolidge are third cousins who have
known each other and have been friends for more than 70 years.
2. Robert M. Frey and Eleanor U. Coolidge were classmates in the Carlisle
Public Schools from first grade through twelve, and then classmates at Dickinson
College, graduating together in the class of 1950.
3. Robert M. Frey received instructions from Eleanor U. Coolidge
concerning changes she wished to make in her Will, and after allowing several days to
pass returned to her with the revised Will prepared in accordance with the earlier
instructions given to him by her.

4. Robert M. Frey is fully confidant that Eleanor U. Coolidge was mentally
competent at the time she executed her Will dated December 8, 2003.

5. Robert M. Frey obtained the presence of Dr. Herbert E. Myers at the time
of execution of the Will by Eleanor U. Coolidge on December 8, 2003, not because of
any doubt Robert M. Frey had as to her mental capacity, but because at that time there
was pending a proceeding brought by Julia Coolidge Stolz seeking to have Eleanor U.
Coolidge declared mentally incompetent, and the presence of Dr. Herbert E. Myers as a
witness was intended to safeguard proving the validity of the Will should the mental
capacity of the Testatrix continue to be challenged by Julia Coolidge Stolz.
6. On December 8, 2003, Eleanor U. Coolidge executed her Last Will and
Testament and at the time of so doing she was mentally competent to do so.
