AND NOW, this 30`" day of April, 2015, upon consideration of American Equity's
Petition for a Rule to Serve the Interest of Justice and this Court having been made
aware that the United States District Court for the Middle District of Pennsylvania has
issued an Order dated March 4, 2015, which directed American Equity to pay the funds
regarding American Equity Annuity Contract Numbers 179442 and 180110 into the
Federal Court and to move for summary judgment;
Accordingly, IT IS HEREBY ORDERED AND DIRECTED that this Court will not
make any Order regarding the determination of the proper beneficiary of American
Equity Annuity Contact Numbers 179442 and 180110; and
IT IS FURTHER ORDERED AND DIRECTED that this Court will not take any
testimony regarding Decedent, George W. Howard's capacity to execute the 2013
beneficiary claim form associated with American Equity Annuity Contracts Numbers
17g442 and 180110.
