AND NOW, this 3rd day of May, 2005, upon consideration of the Petition for the
Appointment of Emergency Guardian of the Person in Accordance with 20 Pa. Cons.
Stat. Ann. 95513 filed by Beverly A. Rohrbaugh, and following commencement of a
hearing at which the subject of the proceeding, Carl S. Barker, II, was not present and at
which medical testimony was not elicited that his physical or mental condition would be
harmed by his presence, and it not appearing that his presence would be unfeasible, the
petition will not be granted at this time and the hearing will be reconvened upon motion
of Petitioner's counsel at such time as his presence can be arranged for.
