specifically described in Exhibit "A" which is incorporated herein and attached hereto.

NOW, April 25, 2005, at the time of and immediately before the execution of the pri cipal
contract. and before any authority has been given by the said Owner to the said Contractor to com ence
work on the said building, or purchase materials for the same in consideration of the making of th said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by 0 ner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, n r by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or xtra
labor or materials purchased for the erection of said building, the right to file such liens being expr ssly
waived.

ALL THAT CERTAIN tract or parcel of land being situate in Hampden Townshi
Cumberland County, Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a point along the northern right-of-way line of Summit Way, sai
point being the southwestern corner of Lot 37, as shown on the "Final Subdivision Plan ~ r
Hampden Summit - Phase 2"; thence, along said right-of-way line on a curve to the left h ving
a radius of 275.00 feet, an arc length of 79.25 feet and a chord bearing of North 27 degre s 52
minutes 55 seconds West a distance of 78.97 feet to a point; thence, along said right-of-w y
line North 36 degrees 08 minutes 14 seconds West a distance of 29.26 feet to a point; the ce,
North 60 degrees 43 minutes 37 seconds East a distance of 152.55 feet to a point; thence,
South 24 degrees 09 minutes 42 seconds East, a distance of 108.43 feet to a point; thence,
South 60 degrees 43 minutes 37 seconds West a distance of 141.31 feet to a point and the
place of BEGINNING.
