MUMPER CONSTRUCTION, INC. Contractor WHEREAS, DAVID B. DENTLER of 1209 Gunstock Lane, Mechanicsburg, Pennsylv nia, is about to execute contemporaneously herewith, a contract, with J. W. Mumper Construction, In . Of 6 Lynchburg Court, Mechanicsburg, Pennsylvania, for the erection ofa building upon premises co monly known as 3 WINCHESTER COURT, Township SILVER SPRING, Cumberland County, Penns Ivania, as set forth in the deed dated January 6, 2005, recorded at Deed Book 267, Page 335, in the Re order's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" hich is incorporated herein and attached hereto. NOW, April 26, 2005, at the time of and immediately before the execution of the p incipal contract, and before any authority has been given by the said Owner to the said Contractor to co mence work on the said building, or purchase materials for the same in consideration of the making of he said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by wner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor nor by any of the material men or workmen or any other person for any labor, or materials purchased, r extra labor or materials purchased for the erection of said building, the right to file such liens being e pressly waived. DENTLER Exhibit A ALL THAT CERTAIN tract or parcel of land with improvements thereon situate in Silv Spring Township, Cwnberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the southern right-of-way line of Winchester Court, at the n rtlrwest corner of Lot No. 16 on the hereinafter described Final Subdivision Plan; thence along the wes ern line of said Lot No. 16, South 07 degrees 59 minutes 19 seconds East, a distance of 245.35 feet to a oint on the northern line of land now or formerly of William E. Keller; thence along the northern lin of said . Keller land and continuing along the northern line of land now or formerly of W. Bennett Co or, Jr., South 71 degrees 49 minutes 55 seconds West, a distance of 239.13 feet to a point at the southe t corner of Lot No. 14 on the hereinafter described Final Subdivision Plan; thence along the eastern r of said Lot No. 14, North 03 degrees 57 minutes 20 seconds East, a distance of 312.24 feet to a po nt on the southern right-of-way line of Winchester Court; thence along the southern right-of-way line of inchester Court by a curve to the left having a radius of 825.00 feet, an arc length of 171.99 feet to a pint at the northeast corner of Lot No. 16 on the hereinafter described Final Subdivision Plan, the point d place of BEGINNING. CONTAINING 55,017 square feet, more or less.
