This matter began with a complaint being filed by Plaintiff on January 29,'201�-�An :'' cn ; � ,::r r-.� answer was filed on February 26, 2013. c., �;,, �:�, -� 'T 2. On March Sth, an Order was signed, scheduling a conference on May 29, 2013. 3. On March 12, 2013, Plaintiff filed Preliminary Objections - On March 19th, Defendant filed an Answer to Plaintiffs Preliminary Objections. 4. On April 2, 2013, A Order of Court was signed for the case to be specially heard on May 8th of 2013. 5. On May 2, 2013, Plaintiff s request to continue the matter was granted- to July 25, 2013. 6. On June 14, 2013, Plaintiffs request to continue the matter was granted - to August 26, 2013. 7. A variety of claims and counterclaims were addressed between June and October of 2013. 8. On October 25, 2013, Plaintiff s unopposed motion for continuance was granted -- to February 13, 2014. �� , �,.,��Y �� �i irn_.i�.n.��.. , 9. On February 11, 2014,Defendant's motion for continuance was granted, rescheduling the matter to June 18, 2014. 10. On June 16, 2014, Plaintiff s motion for continuance was granted -- to August 6, 2014. 11. Motions for exclusive temporary possession of property, subject to partition, and responses thereto were filed between June and August of 2014. 12. On July 26, 2014,Plaintiff John G. Mohl passed away. 13. On August 7, 2014, a Statement of Material Facts for substitution of successor Plaintiff, pursuant to Pa. RCP 2352 was filed; on August 13, 2014, Plaintiff is now Josua Mohl as executor of the estate of John G. Mohl. 14. On August 22, 2014, exclusive temporary possession of the real property in question was granted to defendant, Beverly A. Daum, pending resolution of the Partition proceeding. Additionally, paragraph 5 of that Order stated "In addition to the above access parameters, the parties are prohibited from disposing unilaterally of any asset at issue in this civil case and are directed to preserve assets at issue from further deterioration." 15. On October 9, 2014,This Court entered an Order stating that all of the personal property was to be handled through the estate; This order was entered in this docket and simultaneously in Cumberland County Orphans Court, Docket 21-14-723. 16. On February 12, 2015, this Court entered an Order awarding money damages to Plaintiff and possession of the real property to Defendant. 17. On March 26, 2015, Plaintiffs motion for reconsideration en banc of Judge Placy's Order of Court of February 12, 2015 was denied. � 1 �I.��..,.I1.�•I'�., K 18. Items of personal property which the parties were prohibited from disposing of unilaterally and which were to be handled through the estate administration have already been disposed of by Plaintiff through a public sale,held on October 5, 2014, including: Oak Claw foot table, Oak wash stand, Refinished Eastlake needlepoint chair, pair of framed bluebird prints, and Oak library table. See Exhibit A. 19. Plaintiff was aware of Defendant's claim to these items prior to the public sale, as Defendant had notified Plaintiff of their impending claim prior to either of the Orders referenced above. See Exhibit B. 20. Plaintiffs actions were in direct violation to orders of this Caurt. 21. Defendant, having been awarded the real property in the Order of February 12, 2015,has conferred with Plaintiff by and through his counsel,to have a new deed executed and to refinance the real property in question so as to have the funds to pay the amount due from Defendant to Plaintiff. 22. Plaintiff has refused to sign a deed, conveying the property into the sole possession of Defendant, contrary to the Order of February 12, 2015. See Exhibit C. 23. An action in Civil Contempt, which is remedial in nature requires (1) a private person as opposed to a governmental agency (2)that is continuing the action as opposed to a new cause of action where (3)holding the respondent in contempt would afford relief to the private complainant; also (4) where the relief requested is for the benefit of the complainant, and(5)the acts complained of are civil in nature. See Knaus v. Knaus, 387 Pa. 370, 378 (1956). ...'�•1 II'li._•IT II.T��.�. � 24. In an action in Civil Contempt, a Court may impose remedial punishment of a fine payable to the aggrieved party as compensation for the damages sustained by reason of the offending behavior. See Stahl v. Redcav, 897 A.2d 478, 487 (Pa. Super. 2006). 25. Defendant avers that Plaintiffs actions in disposing of personal property which was in dispute and refusing to sign a deed conveying the real property to Defendant are in direct violation of the clear direction and Orders of this Court. 26. Defendant avers that the actions taken by Plaintiff, as described above, rise to the level of Contempt of Court and, as such, give this Court the reason to award damages to the Defendant from the Plaintiff. WHEREFORE,Defendant respectfully requests that this Court rule that Plaintiffs action of selling personal property which was in dispute and also plaintiffs action of refusing to execute a deed conveying the real property to defendant are in contempt and that this Court order Plaintiff to pay to defendant an amount equal to the fair market value of the items lost, plus an amount of special damages to be set by this Court plus any other relief which this Court deems proper.
