IN RE: ) IN THE COURT OF tOlVvl'N
ESTATE OF KATHRYN E. McBRIDE ) PLEAS OF CUMBE,AND"I

)
) CIVIL ACTION - LAW

) NO. 2114-0874
)
PETITION FOR APPOINTMENT OF GUARDIAN
AND NOW comes Donna M. Helman, personal representative of the Estate of Kathryn
E. McBride and petitions the court for approval to serve as guai•ciian for her minor son, Kenneth
P. Helman, Jr., based upon the following:
1. The Petitioner herein is Donna M. Helman, who was appointed, by the Register of
Wills of Cumberland County on 28 August 2014 as the Executrix of the Estate of Kathryn E.
McBride, deceased. Donna M. Helman is the daughter of tlie decedent.
2. Among the heirs of the estate is Kenneth P. Helman, ,lr., a minor child now age 14,
born on 20 September 2001. Kenneth P. Helman, Jr. is the mirior son of Petitioner.
3. Because of his age, Kenneth P. Helman, Jr., may not receive the funds he is entitled
to receive as an heir of the said estate. Petitioner estimates that the net estate available for
distribution, after payment of Pennsylvania inheritance taxes, administrative costs and debts and
other deductions, will be approximately $155,000.00 and that the 10% share of th estate left by
the decedent to Kenneth P. Helman, Jr., will be approximately $l 5,000.00.
4. The Will of the decedent did not direct or require the creation or funding of a trust for
any minor beneficiaries.
5. The modest size of the distribution to Kenneth P. Helnan, Jr., does not justify the
involvement of a commercial bank or trust company to handle siich minor funds.
6. Petitioner is, by law, the natural guardian of her minor son and is fully authorized to
handle the minor child's finances.
WHEREFORE, Petitioner prays this court to authorize and permit Petitioner to receive
the distributive share of her son Kenneth P. Helman, Jr., born 20 September 2001, until the child
attains his majority and, further, to authorize the Petitioner to sign all necessary receipts,
releases, and other documents in connection with her receipt of the funds on his behalf.
