To the Prothonotary:
AND NOW, comes the Defendant, Brian Verchick, by and through his counsel,
Summers, McDonnell, Hudock, Guthrie & Skeel, L.L.P., and Joshua G. Ferguson,
Esquire, and avers as follows:
1. The Plaintiff, Teresa A. Plesce, filed a Civil Complaint with District Justice
Robert V. Manlove of Cumberland County on February 22, 2005.
2. On or about April 7, 2005, District Justice Robert V. Manlove entered a
Judgment for the Plaintiff in the amount of $2,071.50.
3. On or about April 27, 2005, Defendant's counsel filed a Notice of Appeal
from a District Justice Judgment with the Prothonotary of Cumberland County. (A true
and correct copy of the Notice of Appeal from a District Justice Judgment is attached
hereto as Exhibit "A").
4. On or about May 6, 2005, Defendant's counsel filed Proof of Service of
Notice of Appeal and Rule to File Complaint with the Prothonotary of Cumberland
County. (A true and correct copy of the Proof of Service of Notice of Appeal and Rule to
File Complaint is attached hereto as Exhibit "8").
4. On or about June 7, 2005, Defendant's counsel forwarded a written Notice
of Intent to File the Praecipe to Enter Judgment of Non-Pros to the Plaintiff. (A true and
correct copy of the Notice of Intent is attached hereto as Exhibit "C").
5. To date, Plaintiff has failed to file a Complaint with the Prothonotary.
WHEREFORE, please enter judgment against the Plaintiff, Theresa A. Plesce, and in
favor of Defendant, Brian Verchick, for failure to file a Complaint in civil action within twenty
(20) days from the date of service of the Rule to File a Complaint.
