JONES, a i DOCKET NO. 2015 - O minor PETITION PURSUANT TO 20 PA C.S. §5101(3) OF ROBIN S. JONES TO DIRECT PAYMENT OF INSURANCE BENEFITS OWED TO MINOR 1. Petitioner Robin S. Jones is an adult individual who resides at 9 Mooredale Road, Carlisle, Pennsylvania 17015. 2. Petitioner is the natural mother and legal guardian of three minor children, Autumn M. Jones, Evelyn V. Jones, and Jonathan M. Jones (collectively, the "Children"). 3. The Children are beneficiaries under a certain life insurance policy on the life of Decedent Mark L. Jones, their natural father(the "Policy"). 4. The Policy is through Colonial Life and Accident Insurance Company ("Colonial Life"). 5. The Policy is in the amount of $50,000.00 and lists the Children each as equal primary beneficiaries. 6. Each of the Children is entitled to one-third of$50,000.00 pursuant to the Policy. 7. Colonial Life will not issue the Children's benefits to Petitioner without Order of this Honorable Court. 8. Petitioner brings this Petition Pursuant to 20 PA C.S. §5101(3). 9. Pursuant to Decedent's Last Will and Testament, the Children are also beneficiaries to a testamentary trust holding the residue of Decedent's estate (the "Trust"). 10. The trustee of the Trust is Robert E. Golden-Jones. 11. The Trust and its assets are not subjects of this Petition. 12. Petitioner only seeks direct payment of the benefits owed to the Children under the Policy. 13. Petitioner knows of no adverse interest she holds as to the Children's interest in the benefits of the Policy. 14. Petitioner has not notified the United States Department of Veteran Affairs as the Policy did not arise out of any military service. 15. Petitioner brings this Petition on behalf of her minor child, Evelyn V. Jones, solely for her child's benefit, and therefore requests that her reasonable attorney's fees incurred in bringing this Petition be paid from the subject insurance benefits. WHEREFORE, Petitioner Robin S. Jones requests that this Honorable Court issue an order directing Colonial Life & Accident Insurance Company to make payment in accordance with the proposed order attached hereto.
