Frysinger I, Donald Y. Frysinger, of Carlisle, Cumberland County, Pennsylvania, being of sound and disposing mind, do make, publish and declare this as and for my Last Will and Testament, hereby revoking any and all Wills and Codicils by me at any time heretofore made. FIRST: I do direct that all my just debts, funeral expenses, administrative costs and estate and inheritance taxes be paid by my hereinafter named Executrix as soon after my death as may conveniently be done. SECOND: I do give, devise and bequeath all guns and bows to Donald E. Frysinger upon showing of satisfactory proof, represented by a graduation certificate that he completed a drug treatment course, otherwise to Nicole R. Frysinger to be held for the benefit of Donald E. Frysinger until he provides such proof. THIRD: I do give, devise and bequeath my personal residence at 5 Mountview Road, Carlisle, PA 17013 to Nicole R. Frysinger and Donald E. Frysinger, equally, upon showing of satisfactory proof, prepresented by a graduation certificate that he completed a drug treatment course, otherwise to Nicole R. Frysinger to be held for the benefit of Donald E. Frysinger until he provides such proof. FOURTH: I do give, devise and bequeath unto my spouse, Deborah A. Frysinger, the rest, residue and remainder of my estate, real, personal and mixed, of which I shall die seized and possessed, and to which I may be entitled at the time of my death, of whatever nature and wheresoever located, if my spouse survives me by thirty (30) days or more. FIFTH: In the event that my spouse, the said Deborah A. Frysinger, should not survive me by at least thirty (30) days, I do give, devise and bequeath unto my son, Donald E. Frysinger, and unto my daughter, Nicole R. Frysinger, in equal shares, per stirpes, the rest, residue and remainder of my estate real, personal and mixed, of which I shall die seized and possessed, and to which I may be entitled at the time of my death, of whatever nature and wheresoever located. SEVENTH: In the event that any of my beneficiary(ies) are under the age of twenty-five (25) years at the time of my death, then I do give, devise and bequeath all of their bequests in Trust for the benefit of said beneficiary(ies)to Nicole R. Frysinger, whom I nominate, constitute and appoint as the Trustee of my estate. In the event the said Nicole R. Frysinger predeceases me or is unable or unwilling to serve or, once having qualified ceases to act as the Trustee of my estate, then I do nominate, constitute and appoint a qualified corporate fiduciary, CPA, or attorney, as the Alternate Trustee of my estate. Said Trustee(s) shall serve without the necessity of bond, with the power to accumulate assets and pursue courses of action to collect assets, to invest proceeds and to pay from those proceeds for the following uses and purposes: A. to invest and reinvest the same and to receive the income thereon and therefrom; B. to accumulate the income thereon and therefrom until the aforementioned beneficiary(ies) attains the age of twenty-one (21)years; C. if needed, the Trustee(s) shall pay the yearly premium on a health insurance policy for the aforementioned beneficiary(ies)until said Trust terminates; 2 a D. The Trustee may, however, at his or her own discretion, from time to time before final distribution of the principal of this trust is distributed to my beneficiary(ies), pay and/or apply to or for said beneficiary(ies) maintenance, support, care, and education, the accumulated and accruing net income from this trust and so much of the principal of said trust, in whole or in part, in such manner and to such extent as the Trustee shall deem to be for the interest of such beneficiaries. The Trustee is authorized to make such payments of principal or income on behalf of such beneficiaries without the intervention or appointment of a guardian for such beneficiaries; and E. as the beneficiary(ies) attains the age of twenty-five (25) years, their Trust shall terminate and the Trustee(s) shall thereupon pay the then remaining principal or corpus, together with any accumulated and unexpected income remaining in said beneficiary's portion of the Trust,unto that beneficiary. EIGHTH: I do nominate, constitute and appoint as Executrix of this my Last Will and Testament, Deborah A. Frysinger. My said Executrix shall have full power to do any and all things necessary for the complete administration of my estate, including the power to sell, at public or private sale and without Order of Court, any real or personal property belonging to my estate, and to compound, compromise or otherwise settle or adjust any and all claims, charges, debts and demands against or in favor of my estate as fully as I could do if living. In the event the said Deborah A. Frysinger predeceases me or is unable or unwilling to serve or, once having qualified ceases to act as the Executrix of this, my Last Will and Testament, I do nominate, constitute and appoint Nicole R.
