ANSWER
NOW COME the Defendants, FRANK DEBOLT, FRANK DEBOLT III,
CONCEPT BUILDERS, INC., and CBI HOME PRODUCTS, INC., and
respectfully answer Plaintiffs Complaint as follows:
1. Admitted.
2. Admitted.
3. Admitted.
4. Admitted in part and denied in part. It is admitted that Plaintiff
sold such goods to CBI Home Products, Inc.; it is denied that Defendant
CBI Home Products, Inc., owes the full amount set forth in this
paragraph to Plaintiff. See New Matter hereinbelow.
5. Admitted in part and denied in part. It is admitted that the
prices were just and reasonable and were the prices that Defendant CBI
Home Products, Inc., agreed to pay. It is denied that Defendant CBl
Home Products, Inc., agreed to pay Plaintiff in a lump sum or on a
monthly basis.
6. Admitted in part and denied in part. It is admitted that the
nature of the invoices is voluminous; it is denied that they have
previously been provided to Defendants.
7. Admitted.
8. Admitted in part and denied in part. It is admitted that the
balance due is €48,184.41. It is denied that this amount is required to
be paid in full at this time.
9. Admitted in part and denied in part. It is admitted that the
figure €48, 184.41 converts into $55,248.24. It is denied that this sum is
due and payable in full at this time.
10. Denied. Plaintiff did not "frequently demand" payment. See
New Matter hereinbelow.
NEW MATTER
11. Defendants incorporate their answers to paragraphs 1 through
10 hereinabove as if fully set forth herein.
12. Defendant Concept Builders, Inc., is a duly registered
Pennsylvania corporation in active status.
13. Frank Debolt and Frank DeBolt 1II are employees of Concept
Builders, Inc., and have no personal liability for its debts.
14. Frank DeBolt and Frank DeBolt III should be dismissed
Defendants in this lawsuit.
15. Approximately Ten Percent (10%) of the sinks delivered to
Defendants were broken and unusable.
16. Defendants believe and therefore aver that the faucets may
violate NSPC 2000 Section 7.11 (Sinks Bidets) and therefore it is
unlawful to sell or install the faucets in the United States.
17. The faucet hoses are not compatible with United States
plumbing and must be replaced in every installation.
18. The payment plan agreed upon by the parties prior to shipment
was that Defendants would pay Plaintiff as each sink was sold. The
terms of monthly payments from Defendants before Defendants sold any
sinks accompanied the delivery of the sinks, and were not antecedent to
the delivery.
WHEREFORE, Defendants respectfully request that Your Honorable
Court dismiss Plaintiffs Complaint.
