County, Pennsylvania, make, publish and declare this as and� for `�
my Last Will and Testament, hereby revoking a11 other Wi115 and
Codicils heretofore made by me.
FIRST: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appointment and
together with any insurance policies thereon, unto my husband,
GEORGE C. WEIMER, JR. , provided he survives me by sixty (60)
days .
SECOND: Should my husband, GEORGE C . WEIMER, JR. ,
predecease me or die on or before the sixty-first (61st) day
following my death, I devise and bequeath all the rest, residue
and remainder of my estate of whatever nature and wherever
situate, including any property over which I hold power of
appointment and together with any insurance policies thereon, as
� follows :
� (A) Should my daughter, STEPHANIE A. WEIMER, be re5id-
,� ing at my house at 78 Skyline Drive, Mechanicsburg, Cumberland
\�' County, Pennsylvania at the time of my death, I direct that

during the course of the administration of my estate, but for a
`� period of time not to exceed six (6) months from the date of my

� � death, my daughter, STEPHANIE A. WEIMER, sha11 have the right to
reside in my house at 78 Skyline Drive, Mechanicsburg, Cumberland
JCounty, Pennsylvania. All expenses and upkeep of the house shall

be considered an expense of the administration of my estate and
�� shall be paid by my Executrix. At such time as she no longer
� uses the said house as her principal residence, or six (6) months
after my death, whichever first occurs, said house shall be and
become a part of my residuary estate to be distributed as set
forth hereinbelow in Clause Second C .
(B) I give and devise all of my right, title and
interest in and to the lot, tract or parcel of land lying and
being situate on the waters of Little Laurel Fork of Tanner, in
DeKa1b District, Gilmer County, West Virginia, consisting of real
property and any buildings situated thereon, along with any
mineral rights and leases to dri11 wells, gas and oil, to my
daughter, MALANI A. SINGER. Said real estate is specifically
bounded and described as follows, to wit :
BEGINNING at a stone and running thence N
74 . 5 W 23 poles to two oaks; thence S 63 W 54
poles to a gum and hickory; thence S 11 W 45
poles to a pine and two oaks; thence S 83 E
40 . 5 poles to a dogwood; thence S 19 E 41
poles and 7 links to a pine; thence S 82 E 24
poles to pointers; thence N 77 E 34 . 5 poles
to a stone; thence N 7 E 50 poles to a stone;
thence N 81 . 25 E 10 . 25 poles to a stump;
thence N 4 W 44 . 5 poles to a stone; thence N
61 W 20 . 25 poles to a large C .O. by rocks ;
and thence 5 86 W 24 poles to the place of
beginning, containing sixty-five (65) acres
and fifty-five (55) poles, being the whole of
two parcels of 26 acres 107 poles and of 38
acres 109 poles, respectively; and being the
same real estate which was conveyed unto M.
� F. Gainer by L. E. Ellyson and wife by deed
dated May 27 , 1901 and recorded in the office
of the Clerk of the County Court of Gilmer
V County in Deed Book No . 45 at Page 371 .

estate to my son, MICHAEL J. WEIMER. Should MALINI A. SINGER,
� GEORGE C . WEIMER, III , and MICHAEL S. WEIMER predecease me, I

give and devise a11 of my right title and interest in and to said
real estate to my daughter, STEPHANIE A. WEIMER.
(C) 1 devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appointment and
together with any insurance policies thereon, in equal shares, to
my children, NL�LINI A. SINGER, GEORGE C. WEIMER, III, MICHAEL
JOHN WEZMER and STEPHANIE A. WEIMER, provided that should any of
my children predecease me, I give and bequeath such child' s share
unto his or her natural children in equal shares . If any of my
children predecease me, not being survived by natural children,
then I give and bequeath such deceased child' s share, in equal
shares, to my surviving children as set forth herein.
(D) The share or shares created herein for my chil-
dren, MALANI A. SINGER, GEORGE C . WEIMER, III, MICHAEL J. WEIMER
and STEPHANIE A. WEIMER, shall be charged with any debts owed to
me by them.
THIRD: Should any of my natural grandchildren not have
attained the age of twenty-two (22) years at the time for dis-
tribution to him or her, I give, devise and bequeath the share of
� each such natural grandchild to my hereinafter named Trustee or
� Trustees, IN SEPARATE TRUSTS, to hold, manage, invest and rein-
F vest the shares so received, and to use and apply from time to
\
time such portion of income and principal for the said natural
\� grandchild' s education (including college, trade school or other
1 similar training or education) , as my Trustee or Trustees, in
� � their sole discretion, deem advisable. The Trustee or Trustees,
� in exercising their discretionary authority with respect to the
J payment of income or principal of the within Trust to my natural
� grandchildren, sha11 take into consideration any income or other
resources available to my natural grandchildren from sources

Any income or principal not so applied shall be dis-
tributed to each natural grandchild when he or she attains the
age of twenty-two (22) years . In the event any of my natural
grandchildren die prior to the termination of this Trust
established herein for their benefit, the interest of said
natural grandchild in said Trust shall cease with any income and
principal being divided evenly between or among that deceased
natural grandchild' s brothers or sisters or the separate Trusts
established hereunder for their benefit and, in the absence of
any brothers or sisters, or any Trusts established hereunder for
their benefit, to my other natural grandchildren, or the Trusts
established hereunder for their benefit, in equal shares .
FOURTH: In addition to all powers granted to my
Executor or Executrix, Trustee or Trustees, as the case may be,
and their successors, by law and by other provisions of this
Will, I give these individuals, who are herein otherwise referred
to as fiduciaries, acting hereunder the following powers, appli-
cable to al1 property, exercisable without court approval and
effective until actual distribution of all property:
(A) To sell at public or private sale, or to lease,
for any period of time, any real or personal property and to give
J options for sales, exchanges or leases, for suCh pYices and upon
� such terms (including credit, with or without security) or
� conditions as are deemed proper. This includes the pOwer to give
� legally sufficient instruments for transfer of the property and
� to receive the proceeds of any disposition of it .
(B) To partition, subdivide, or improve real estate
J and to enter into agreements concerning the partition, subdivi-
aI
� sion, improvement, zoning or management of real estate and to
� impose or extinguish restrictions on real estate.
1 (C) To compromise any claim or controversy and to
\
abandon any property which is of little or no value.

(D) To invest in a11 forms of property, including
stocks, bonds, municipal funds, trust funds and mortgage invest-
ment funds, without restriction to investments authorized for
Pennsylvania fiduciaries, as are deemed proper, without regard to
any principle of diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments .
(F) To exercise any election or privilege given by the
Federal and otner tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my wi11, and for
investment purposes .
(I) To select a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee
stock ownership plan, or any other type of qualified plan) to the
extent the plan or the law permits them to do so, and to exercise
. i any other rights which they may have under the plan, in whatever
f manner they consider advisable.
J FIFTH: I nominate and appoint my daughter, STEPHANIE

� A. WEZMER, as Trustee of the hereinabove described Trusts . In
�� the event of the death, resignation or inability to serve for any
1 reason whatsoever of the said STEPHANIE A. WEIMEA, I nominate and

d appoint my son, GEORGE C . WEIMER, III, as Trustee of the

Trustee of the hereinabove described Trusts. I direct that my
Trustees shall serve without bond and may receive fair and
reasonable compensation.
SIXTH: I direct that all inheritance, estate,
transfer, succession and death taxes, of any kind whatsoever,
which may be payable by reason of my death, whether or not with
respect to property passing under this Will, shall be paid out of
the principal of my residuary estate.
SEVENTH: A11 interests hereunder, whether principal or
income, which are undistributed and in the possession of the
fiduciaries acting hereunder, even though vested or distribut-
able, shall not be subject to attachment or execution in any
manner for any debt, contract, obligation or liability of any
beneficiary, and furthermore, shall not be subject to pledge,
assignment, conveyance or anticipation.
EIGHTH: I nominate and appoint my husband, GEORGE C.
WEIMER, SR. , Executor of this, my Last Will and Testament. In
the event of the death, resignation or inability to serve for any
