1. The petitioner herein is Kimberly J. Gould, the widow of the decedent Steven C.
Gould. She was appointed Administratrix of her late her husband's estate on 16 January 2015.
2. The decedent left three children, one of whom is now an adult and the other two of
which are minors. The children are:
A. Preston Gould, who is now 18, having been born on 8 February 1997.
He resides with his mother Adrianna Brumbaugh, the decedent's prior wife, at
706 Henry Street, Mechanicsburg, Pennsylvania 17055;
B. Madison Gould who resides with her mother Adrianna Brumbaugh,
the decedent's prior wife, at 706 Henry Street, Mechanicsburg, Pennsylvania
17055; and
C. Kennedy Gould, age 4,who resides with her mother, the decedent's
second wife and the Petitioner herein at 2130 Canterbury Drive, Mechanicsburg,
Pennsylvania 17055.
3. The assets in the estate are very limited. The gross estate, before the payment of
any expenses, is less than $37,000.00. After payment of the expenses of administration, the
decedent's debts owed at the time of separation, and Pennsylvania inheritance tax, Petitioner
estimates that the balance on hand for distribution to the beneficiaries will be approximately
$20,000.00.
4. The natural guardian of Madison Gould is her mother,Adrianna Brumbaugh who
resides at 706 Henry Street, Mechanicsburg, Pennsylvania.
5. The natural guardian of Kennedy Gould is your Petitioner, Kimberly J. Gould who
resides at 2130 Canterbury Drive, Mechanicsburg, Pennsylvania.
6. Under the intestate laws of the Commonwealth of Pennsylvania, each of the
decedent's minor children will receive 16.67% of the estate, which will represent less than
$3,400.00 to each minor beneficiary.
7. It is not practical, under these circumstances, to fund a trust or a formal
guardianship with a third party for the benefit of the minor children.
8. Pursuant to Chapter 51 of the Pennsylvania Decedents, Estates, and Fiduciaries
Code, and specifically Section 5101 (20 P.S. 5101) the court is authorized to permit the
distributive share of a minor beneficiary, which is less than $10,000.00, to be paid to the parent
of the minor beneficiary without the appointment of a guardian.
WHEREFORE, Petitioner prays this court to grant her leave to pay the distributive
share of each of the minor children named in this petition to their mothers also identified in
this petition.
