EIGHTH. In addition to the specific bequest in Paragraph THIRD, I give and bequeath
to my niece, ruSTlE M. McClJFVY, my saphi re ring in a \Nhi te gold sett ing. In the
event the said Dustie M. McCUrdy should predecease me or is no longer I iving on the
sixtieth (60th) day fol lowing my death, I then give and bequeath said saphire ring in
\Nhite gold setting to my nice, M^IN L. rJcOJRDY.
NINTH.
give and bequeath the full sun of ONE THOUSAND ($1,000.00) DOLLARS to

EUGENE H. lV\cCURDY. In the event that the said Eugene H. lV\cCurdy should predecease me
or is not living on the sixtieth (60th) day following my death, I then give, devise
and bequeath the rest, residue and remainder of my estate, in equal shares, to my
brother, [X)\lALD L. lV\cClJRDY, and my sister, JOYCE A. VI LlAREAL. on a per st i rpes
distribution basis.
1VvELFTH. I nominate, constitute and appoint my brothers, BUGENE H. rJcClJRDY, and
cx::NAJ..D L. McCURDY, and my sister, JOYCE A. VILLAREAL, or the survivor thereof, to be
the Co-Executors of th is my Last Wi II and Testament. I n the event that none of the
above-named brothers and sister be able to fufi II the duties of Co-Executor, I then,
and in that event, nominate, constitute and appoint my sister-in-law, DARLENE M.
lV\cCURDY, and ITo/ brother-in-law, GUIDO VILLACRES, or the survivor thereof, to be the
Co-Executors of this my Last Wi II and Testament.

F AMIL Y SETTLEMENT AGREEMENT
THIS AGREEMENT made this ~ day of ~ ' 2002,
BETWEEN: EUGENE H. MC CURDY, DONAL. L. MC CURDY,
DUSTIE M. MC CURDY, DAWN L. MC CURDY, JOYCE A. VILLAREAL,
ALEXANDER VILLAREAL, and JESSICA VILLAREAL, being the legatees under the
Last Will and Testament of Larry H. McCurdy, late of the Township of Southampton,
Cumberland County, Pennsylvania,
AND
EUGENE H. MC CURDY, DONALD L. MC CURDY, and JOYCE A.
VILLAREAL, Co-Executors of the Estate under the Last Will and Testament of Larry H.
McCurdy, deceased,
WHEREAS, Larry H. McCurdy died March 2, 2001, testate, and under his Will
left his estate to the parties herein; and
WHEREAS, Letters Testamentary were granted to Eugene H. McCurdy, Donald
L. McCurdy, and Joyce A. Villareal on March 12, 2001, by the Register of Wills of
Cumberland County, Pennsylvania; and
WHEREAS, all assets of the late Larry H. McCurdy have been liquidated or
distributed and all his debts paid in full, and further the period of four months having
been terminated since the first advertisement of the issuance of Letters to the said Co-

Executors, the said parties hereto desire to waive the duty of the Co-Executors to file
a First and Final Account with Proposed Schedule of Distribution for purposes of
confirmation by the Court of Common Pleas of Cumberland County, Orphan's Court
Division, AND FURTHER desire that a Family Settlement Agreement be executed,
which Family Settlement will be duly recorded among the deed records in and for
Cumberland County.
NOW, THEREFORE, WITNESSETH, that the parties hereto, in consideration of
the premises above stated, and of the Accounting and Proposed Schedule of Distribution
attached hereto and made a part hereof, and the receipt of their distributive shares as
therein shown, do mutually bind themselves to the said Distribution and Accounting as
set forth and further mutually release each other and in particular Eugene H. McCurdy,
Donald L. McCurdy, and Joyce A. Villareal, Co-Executors, from all claims and demands
whatsoever arising out of settlement of the Estate of Larry H. McCurdy.
The parties hereto do further agree that should any liability come due to the estate
of the said decedent after the signing of this agreement, we and each of us do hereby
covenant and agree with each other and the aforesaid personal representatives that we
will contribute pro rata our share of the estate to satisfy any and all claims, demands,
suits, or causes of action which may be successfully prosecuted against the said estate or
the aforesaid personal representatives after the signing, sealing and delivery of this family
settlement agreement and final release.
