STIPULATION AGAINST LIENS

THIS AGREEMENT made this;q day of /IJJbJ 2004, by and
between Hoffman's Custom Contracting, Inc., of 35 Chelsea Lane,
Cumberland County, Carlisle, Pennsylvania, hereinafter referred to
as Contractor,
AND
BARRY S. BOWMAN AND PATRICIA L. BOWMAN, husband and wife,
hereinafter referred to as Owners. Whereby the contractor
undertook and agreed to erected and construct a dwelling on the
certain lot of ground situate in Dickinson Township, Cumberland
County, Commonwealth of Pennsylvania, and more fully described in
Exhibit "A" which is attached hereto and made a part hereof known
as Lot #28 Makenzee Drive, Cumberland County, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic'S liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Exhibit A
ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland County,
Pennsylvania, bounded and described iu accordance witb Subdivision Plan for Annendale
prepared by Statler-Brehm Associates, Inc., dated April 12, 1995, a copy of which consisting
of six (6) pages was recorded on December 23, 1996 in the hereinafter named Recorder's
Office in Plan Book 73, Page 111, etc. which Piau is incorporated herein by reference, as
follows:
BEGINNING at a point on the western line of 50 feet wide Makenzee Drive at the dividing
line between Lots No. 27 and 28: thence from said point at the place of beginuing along said
western line of said 50 feet wide Makenzee Drive, South 42 degrees 01 minutes 49 seconds
East a distance of 222.41 feet to a point at tbe dividing line between Lots Nos. 28 and 29;
thence along said dividing line between said Lots Nos. 28 and 29, Sontb 47 degrees 58
minutes 11 seconds West a distance of 249.13 feet to a point on the eastern line of Lot No.
26; thence along the dividing line between a portion of the eastern line of said Lot No. 26
and Lot No. 28, North 43 degrees 33 minutes 44 seconds West a distance of 155.00 feet to a
point at corner common to said Lots Nos. 26 and 27 and 28: thence along said dividing line
between Lots Nos. 27 and 28, North 33 degrees 03 minutes 44 seconds East a distance of
262.11 feet to a point on the western line of 50 feet wide Makenzee Drive at the Place of
BEGINNING.
The above described lot of land is all of Lot No. 28 as shown on said Subdivision Plan for
Annendale recorded as aforesaid, and contains an area of 47,467 square feet or 1.090 acres,
more or less.
The above described lot of land has the mailing address of21 MakenzeeDrive,Carlisle,PA
17013.
