STIPULATION AGAINST LIENS
THIS AGREEMENT made this ~ay of ;11 ~ 2005, by and
between Madison & Sons Construction, LLC, of carli~ie, Cumberland
County, pennsylvania, hereinafter referred to as Contractor,
AND
Jeffrey S. Gayman and Christine P. Gayman, husband and wife,
hereinafter referred to as Owner, whereby the contractor undertook
and agreed to construct improvements to the dwelling on the certain
lot of ground situate in Penn Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as 70
Pine Creek Drive, North Middleton Township, Cumberland County,
Carlisle, PA.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

Victor J. Madison and Anthony J. Grimes, Members of Madison & Sons
Construction LLC, known to me (or satisfactorily proven) to be the
persons whose names are subscribed to the within instrument, and
acknowledged that they executed the same for the purposes therein
contained and in the capacity therein stated.

Exhibit A
ALL THAT CERTAIN tract of land situate in North Middleton Township,
Cumberland County, Pennsylvania, designated as Lot No. 39 on the Final
Subdivision Plan Phase A of The Village of Cross Creek recorded April 4, 2002 in
Plan Book 85, Page 20, more particularly bounded and described, as follows:
BEGINNING at a point on the northern right-of-way of Pine Creek Drive, said
point being the southeastern corner of Lot #40; thence, along Lot #40 N 28021 '25"
W a distance of 125.00' to a point; thence, along Lot #50 and 51 N 53027'28" E a
distance of 64.07' to a point; thence, along Lot #38 S 44043'38" E a distance of
125.00' to a point on the northern right-of-way of Pine Creek Drive; thence, along
the right-of-way by a curve to the right having a radius of 350.00', an arc length of
100.00' and a chord bearing of S 53027'28" W with a chord length of 99.66' to a
point, the place of BEGINNING.
BEING Lot No. 39 on the Final Subdivision Plan for Phase I of the Village of Cross
Creek dated February 20,2002 and recorded April 4, 2002 in Plan Book 85, Page
20.
