WHLREAS, a document refereizced as an "Addencfum io Will of: Marlin II.
Miller" was also provided to the Register for consideration of enforcement as a Codicil of
the decedent;
WHI;RLAS, the only individual to benef t by the terms �f the Addendum was tlle
decedent's wido�, Kathy McKenzie, n/1</a Kathy L. Miller.
NOW TIILREFORE, the Co-�xecuh-ices, and the sol�, beneficia�y of the terms of
the Addendum, stipulate and agree as follows:
1. The Addendum document submitted to the Register along with the decedent's
Last Will ancf Testament, is deiicient relative to its terms and the legal
requirements of a Codicil.
2. The Co-Executrices, on behalf of the estate and the na�ned beneficiaries in the
Last Will and Testament, wish to withdraw the Addendum from consicleration by
the Register of Wills for enforcement as part of tl�is estale.
3. The decedent's widow, who is the sole beneficiaiy of the terms of the Addendum,
wishes to see that the Acidendw�� submitted to the Register of Wills for

consideration for enforcement be withdrawn and that the Addendum not be
considered by the Register of Wills.
4. All parties believe that the Addenduin lacks suff cient clarity relative to the
application of the terms of the Addenduni and otherwise would be unenforceable.
