DETAILED STATEMENT OF QUESTIONS REQLIIRING ADJUDICATION
The estate has a receivable in the amount of$1,810.00 representing a debt owed to the
decedent by Jeanette Tharpe stemming from criminal charges against her initiated by the
decedent, resulting in a CQurt ordered restitution of$5,000.00. At the. time of Mr. Adams's
death, Ms. Thorpe owed �a balance of$3,380.00. At the date of the filing of this Accounting, Ms.
Thorpe still owed a balance of$1,810.00.
Mr. Adams's Last Will provided for distribution of the r�sidue c,f his Estate outright and
absolutely to four (4) charities in equal one-fourth ('/4) shares, to wit:
a. American Red Cross 25%
b. First Church of God 25%
c. Grace United Methodist Church 25%
d. Lincoln Chapel 25%
The only known outstanding debt owed to Mr. Adams is Ms. �'horpe's restitution
payment(s). Currently l�✓Is. Thorpe's payments are made spor.adically and in varying amounts,
mostly small in relative terms. To keep the estate open solely for the purpose of receiving
sparadic and small payrnents would be burdensome and inefficient fer all parties involved.
As a result, a full assignment of future payments is expected to be made per Court Order
to the four (4) aforesaid charitable beneficiaries. Supervision of such payments and the
assignment made there,cf is administered capably by the Cumberland County Probation Office.
A copy of that Order directing the Assignment is attached hereto.
Accordingly, Petitioner respectfully requests an ORDER officially confirming said
Assignment. Petitioner also respectfully requests an ORDER discharging it from its duties as
Executor with allowance to proceed to close the Estate in view of the said Assignment.
