STIPULATION AGAINST LIENS
THIS AGREEMENT, made the :'/

day of A1ffl1, 2005, by and between Wolf
Builders, Inc. (herein referred to as "Contractor"), and Michael Stiltner and Susan Stiltner
(hereinafter referred to collectively as "Owner").
WHEREAS, the Contractor has undertaken and agreed to erect and construct a residence
on Owner's real property known and numbered as Lot #31, Annendale, Cumberland County,
Pennsylvania, and as more particularly described on Exhibit "I" attached hereto and incorporated
herein by this reference.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar ($ 1) Dollars to it in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the
Addendum aforesaid, for themselves and their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanics liens or claims thereto for or on account of
any work done or materials furnished by them or any ofthem under said contract or otherwise
for, towards, in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for themselves, their subcontractors and others under them
hereby expressly waive and relinquish the right to have, file and maintain any mechanic's liens or
claims against the said buildings real property or any of them, and agree that this instrument,
waiving the right of lien, shall be an independent covenant.

EXHIBIT "1"
DESCRIPTION OF REAL ESTATE
ALL THAT CERTAIN lot of land situate in Dickinson Township, Cumberland
County, Pennsylvania, bounded and described in accordance with Subdivision Plan for
Annendale prepared by Statler-Brehm Associates, Inc., dated April 12, 1995, a copy of
which consisting of six (6) pages was recorded in the Office of the Recorder of Deeds in
and for Cumberland County, on December 23, 1996, in Plan Book 73, Page 111, etc,
which Plan is incorporated herein by reference, as follows:
BEGINNING at a point on the Northem line of 50 foot wide Makenzee Drive at
the dividing line between Lots Nos. 30 and 31; thence from said point at the Place of
BEGINNING along said northern line of said 50 foot wide Makenzee Drive, South 66
degrees 58 minutes 11 seconds West a distance of 195.00 feet to a point at the
dividing line between Lots Nos. 31 and 32; thence along said dividing line between said
Lots Nos. 31 and 32, North 23 degrees 01 minutes 49 seconds West a distance of
234.41 feet to a point at corner common to Lots Nos. 25 and 26 and 31 and 32; thence
along the dividing line between said Lots Nos. 26 and 31, North 59 degrees 52 minutes
30 second East a distance of 196.50 feet to a point in line of Lot No. 29; thence along
the dividing line between Lot No. 31 and a portion of Lot No. 29 and the Westem line of
Lot No. 30, South 23 degrees 01 minutes 49 seconds East a distance of 258.68 feet to
a point on the Northern line of 50 foot wide Makenzee Drive at the Place of
BEGINNING.
THE ABOVE described lot of land is all of Lot No. 31 as shown on said
Subdivision Plan for Annendale recorded as aforesaid, and contains an area of
48,076.44 square feet or 1.103 Acres, more or less.
THE ABOVE described lot of land has the mailing address of 15 Makenzee
Drive, Carlisle, PA 17013.
BEING the same property which Linwood B. Phillips, Jr. and Alice R. Phillips,
husband and wife, and Robert M. Frey and Elva F. Frey, husband and wife, by their
Deed dated December 17, 2004, and recorded in the Office of the Recorder of Deeds
in and for Cumberland County, in Deed Book 266, Page 3787, granted and conveyed
unto Michael R. Stiltner and Susan R. Stiltner, husband and wife.
