AND NOW, this 22nd day of July, 2015, this being the '9ime -9
and place set for a hearing on a permanent guardianship of the
estate and the person of Marilyn L. Meeks, and following a hearing
in this matter wherein Marilyn Meeks was represented by Grace
D'Alo, Esquire, and the Petitioner, Gregory Meeks, having been
represented by David Nesbit, Esquire, and Ms . D'Alo having
indicated that she believes that her client is not incapacitated,
and that further testimony would be needed from medical personnel
on behalf of the incapacitated, and medical testimony on behalf of
the Petitioners to support their Petition, and this Court now
requiring an independent medical evaluation to be completed of
Marilyn Meeks, an independent evaluation of Marilyn Meeks ' capacity
to act on behalf of her estate and her person is hereby ordered to
be completed and the results thereof presented at the next hearing
in this matter. It is noted that this Court has given, pursuant to
Title 20, Section 5511 (d) , consideration to the alleged
incapacitated person' s request for the appointment of an evaluator
that she has nominated. Accordingly such independent evaluation
shall be completed by Doctor Dash of John Hopkins
Neuropsychological Unit as per the alleged incapacitated person' s
request .
The Emergency Temporary Guardianship as previously ordered
by this Court on July 2nd, 2015, shall not continue pending this

further evaluation as ordered herein. It is noted that this Court
has made this decision in part on the representation that Yvonne
August, the daughter of Marilyn Meeks, has indicated to this Court
that she will be taking care of her mother at her mother ' s home in
Mechanicsburg, Pennsylvania, and that she will be with her mother
24 hours a day, 7 days a week, to ensure her mother ' s safety, and
further, that she would not be taking her mother out of state,
except for the purposes of getting an independent medical
evaluation or treatment as authorized by her medical physicians and
as authorized by this order. Such results and/or report, including
the doctor ' s curriculum vitae, shall be turned over to Petitioner ' s
counsel within seven days of the preparation of that report . The
report shall at a minimum be turned over to Plaintiff' s counsel at
least 10 days prior to the next hearing in this matter. The Court
will hear further testimony on the Permanent Petition for Guardian
of the Person and Estate of Marilyn Meeks on Friday, September 18 ,
2015, at 9 : 30 a .m. , in Courtroom Number 5 .
