COMPLAINT IN CIVIL ACTION
1. Plaintiff, THE VENDARE GROUP (hereinafter "plaintiff') is a corporation
with an address of 15260 Ventura Boulevard, Suite 2000, Sherman Oaks, CA 91403.
2. Defendant, SEVEN TURTLES, INC. (hereinafter "defendant") is a
corporation operating under the laws of the Commonwealth of Pennsylvania with offices
at 416 Fourth Avenue, New Cumberland, PA 17070.
3. On or about March 19, 2004 defendant executed an Insertion Order with
plaintiff in order to arrange the sale of plaintiff's services on credit to defendant. A true
and correct copy of said Insertion Order is attached hereto, made a part hereof and
marked as Exhibit "1".
4. Between on or about May 1, 2004 and July 1, 2004, plaintiff, at the
request of defendant and in reliance on the aforementioned Insertion Order, performed
certain services at the times and in the amounts as fully set forth on plaintiff's invoices,
true and correct copies of which are attached hereto, made a part hereof and marked
as Exhibit "2".
5. The prices charged for the said services were the fair, reasonable and
market prices of the same at the time they were sold and provided to the defendant and
further are the prices it agreed to pay.
6. After all payments have credited, an outstanding balance due in the
amount of $10,763.80 remains due plaintiff but defendant has failed or refused to pay
the same or any part thereof.
7. In addition to outstanding principal, plaintiff is entitled to interest at the
legal rate of 6% per annum from an average due date of June 15, 2004.
WHEREFORE, plaintiff requests judgment in its favor and against the defendant
in the principal sum of $1 0,763.80 plus interest at a rate of 6% per annum thereon from
June 15, 2004 together with costs.
