AATD A'OW, comes Petitioner, Donald Stoner, by and through hie counael,
Saidis, Sullivan & Rogers, to file the within Petirion foi Settlement of Small Estate
FIled Under 20 Pa. C.S_A. § 3102, and in snpport thereof, avexs the following:
1. Decedent, dacelyn Stoner, died on June 23, 2015. See, Exhibit A—
Death Certificate.) Petitioner, Donald Stoner, was decedent's husband.
2. At the time of her death, Decedent resided in her home at 808 Beacon
Hill Road.
3. Decedent died testate. Decedent executed her Last Will aud
Teetament on August 20, 2012. See, Exhibit B—Last Will and Testament (the
«W�,��)
4. In Item II of her Will, Decedent bequeathed the rest, residue and
�
remaindex of her estate W Petitioner.
5. In Item VI of her Will, Decedent named Petitioner to be her Executor.
6. On the date of her death, Decedent owned 94 shares of demutualized
Prudential stock. (Ex. C — Shareholder letter from Prudential.) The demutualized
shares of Prudential stock are the only asset Decedent owned individually.
Decedent owned all other assets jointly with Petitioner.
7. The value of the Prudential stock at her date of death was $8,583.61.
See, Exhibit D — Prudential Stock average of high and low price on June `L3,
2015J
8. All other assets owned by Decedent were either jointly owned or had a
deaignated beneficiary.
9. Petitioner paid Decedent's total funeral expensee of$ 6,056.57. See,
Exhibit E J
10. Petitioner paid Decedent's outstanding credit card bill of$10.00. See,
Exhibit F.) Decedent did not have any other outstanding debts.
11. To inheritance tax will be due as the statutory rate for assets inherifed
by a spouse ie 0%.
12. Under 20 Pa. QSA. §3102, an Orphans' Court may direct distribution
of propexty without an appraisement.
13. Under 20 Pa. C.S.A. §3102, PeEitioner, as an Executor and Beueficiarg,
has an intei�est in the distribution of the BO deinutnalized shares of Prudential
stock.
14. Under 20 Pa. C.S.A. §3102, a Decree of Distribntion issued by an
Orphane' Conrt constitutes sufficient authority to txanefer property to a beneficiarp.
15. Petitioner requests this Orphans' Court to issue a Deciee of
Distribution so that he, as Executor can have Prudential distxibute the 94
deinutualized stock shares to him as the beneficiary of his late wife's Laet Will and
Testament.
