in this case having been held on FI o u �� , Z015, aod i[appeazing to the Court
that James E. Hagan was served with a Citation and Notice of this heazing on
� � 2015,the Court finds the following from the testimony:
1. The alleged incapacitated person,James E. Hagan, suffered a massive stroke on
or about Augus[ 6, 2015. This condition has totally impaired his capacity[o
ieceive a�d evaluate information effectively[o make and communicate decisions
concerning the ma�agemen[of his financial affairs. This condition totally
impairs his capaciTy to meet essential requirements for his physical health and
safety.
2. That there are insufficient supports available to assis[James E. Hagan in
overeoming such limitations and that there exists no less restdctive alternative
mechanism for decision making other than the appoinhnent of a plenary
guardian of lhe person and a plenary guazdian of the estate.

3. That based on the incapaciry of James E. Hagan to receive and evaluate
informatio� and to make or communicate decisions, a plenary guazdian of the
person and a plenary guazdiari of the estate are required on a permanen[basis.
NOW, THEREFORE, IT IS ORDERED, ADNDGED AND DECREED
ttiat James E. Hagan be a�d is hereby adjudged a totally incapacitated person and that his
brother, James AIbeR Hagan is appointed Plenary Permanent Guardian of the Person and
Plenary Peananen[ Guazdia� of the Esta[e.
7ames Albert Hagan being the plenary guardian of the person, shal] have plenary
powers over the person of James E. Hagan, including bu[ not limited to, full authority ro
consent to the general care, maintenance and custody of James E. Hagan; the authoriry to
desi{,ma[e a place for James E. Hagan to live; to make healthcaze decisions;and the authority
[o provide required consents or approvals on behalf of 7ames E. Hagan which are necessary
for the well-being of his person. 7ames Albert Hagan shall assure that James E. Hagan
receives appropriate services and shall, if reasonably possible, assist him in developing self-
reliance and independence.
James Albert Hagan, being the plenary guardian of the esta[e, shall have plenary
powers over the estate of James E. Hagan, including but not limited to the authorization to
access the financial records of James E. Hagan whether those recocds be at a Bank, a
Credit Union, a Brokerage 5rm or elsewhece a�d also the authorization to spend income
and principal of the estate for the benefit of James E. Hagan. For the care or maintenance
of James E. Hagan, James Albert Hagan is authorized to spend up to $1Q000.00 of the
principal assets of James E. Hagan.
As guardian, on behalf of James E. Hagan, lames Albert Hagan shall have the
authority to engage in Vansactions with the Internal Reve�ue Service and the Pennsylvania
Department of Revenue. These hansactions shall include, but not be IimiteA tq filing
Federal Income Tax Returns, filing Pe�nsylvania lncome Ta�c Retums and requesting copies
of previously filed taac retums.
If income or principal funds of James E. Hagan are available or become
available, the guazdian is authorized to esfablish a prepaid irrevocable burial account for
James E. Hagan up to the curre�t medical assistance allowable amount.
Guardian shall not transfer, sell,encumber or cause any rea1Ty or title thereto
currently owned by 7ames G. Hagan to become encumbered or affected in any manner
unless they have first made application to this Court and subsequenUy have received the
expiess wdtten approval therefrom.
Guardian shall not be required to post bond.
i'he Power of Attorney document appointing lean Ishman as age�t for James E.
Hagan is hereby revoked.
If[here is a safe deposit box in the name of James E. Hagan alo�e or in the
names of James E. Hagan and another or others, said safe deposit box shall not be entered
by the guardian except in the presence of a represen[ative of the fmancial ins[itution where
the box is located or in the presence of a representative of the Orphans' Court Division. If
the safe deposit box is jointly owned, five (5) days' notice of the proposed entry shall be
given to the other owners by the guazdian. The representative present at the time of entry
shall make or cause to be made a record of James E. Hagan's property, and said record shall
be filed with the Clerk of[he Orphans' Court Division. None of James E. Hagan's property
may be removed until after the aforesaid inventory is completed.
An Inventory must be filed by the guazdian within ninety (90)days. A repoR by
each guardian shall be filed within ninery(90)days and amwally theceafter.
