MOTION IN LIMINE
AND NOW comes the Petitioner,J. Edwacd Clouse(herein "Edward" or"Peti6oner"),
by and through his attorney, Nei] Wamer Yahn, Esquire, of JSDC LAW OFFICES, who upon
valid information and bclief hereby submits the below Motion in Limine as foliows:�
L This Motion in Limine is bcing presented before this Houorable Court stemming
from counsePs wllective prepazations for the G�ardianship hearing wrrently seheduled for
Friday, August 21, 2015 9:00 a.m. regarding[he alleged incapacita[ed person, namely Calene M.
Clouse (herein"Ca[ene").
2. As outliued in the attached correspondence (sce Exhibit"A").counsel had a
confere�ce call late last week to discuss tes[imo�y and procedures for the upcoming Hearing.
3. As dise�ssed lherein, counsel for Calene indica[ed that Calene would be presen[ a[
the Hearing however an objection would be lodged with respect to any attempts by Petitioner to
call Calene for purposes of testimony.

4. In s�pport[hcreof, counsel has had the opportu�ity to review [he Estate ofTaylor,
21 Fiduc. Rep2d 205 (Mont. OC 2001) �o which a true and corzect copy thereof is attached
hereto and marked as Exhibit `B".
5. As outlined by Judge Ott iu his opinion, "there is a dearth of authoriry on this
question" (see Taylor, p. 209; page 3 of Hxhibit"B") regarding a pctitioner s abiliry to compel
the testimony of the alleged incapacitated perso� in guardianship proceedings.
6. As a result, Judge Ott sets forth a procedure for such iustances which is reflected
as fullows:
The petitioner will have the initial burden of making out at least a prima fhcie case of
incapacity without the respondenYs own testimony. We suggest that this is a lesser
burden than the "clear and comincing" standard required before an adjudication of
incapacity can be made. If this initial case is set forth, the respondeot will be subject to
q�estions from the bench. In theory, this eolloquy will be in the form of an interview,
rather than direc[or cross examination. Furthermore, no questions will be posed by
counsel for either the petitioner or the respondent uoless the alleged incapacitated person
(or his counscl) acquiesces to same. If counsel for the respondent chooscs to conduct
direct examinatioq eounsel for the petitioner will be given [he opportonity ro cross
examine the respondent. Thercafte�, counsel for the petitioncr will offer other evidence (if
evailable and necessazy) ro attempt to meet the`clear and convincing' burden. If counseL
succeeds, counsel for the respondent will then offcr his evidence[o attempt ro rcbut the
petitione2s casc (see Taylnr, p. 212; page 5 of Exhibit"B"; emphasis in ongina�.
7. The Taylor casc is being presented herein as Petitioner is desirous of es[ablishing
the appropriatc procedures for Calene's- testimony in advance of the Hearing on August,2] so all
parties can proceed co�sistent Iherewith, provided howevcr, Petitioner believes[he above case
acts as guidance but in Ihe even[tha[Petilioner establishes a prima jacie case wi[hout the
RespondenPs testimony,Petitioner avers he should be able to call Calene for direct examination
to address incapacity and not be limited to questio�s from the bench.
8. Peationer believes direct examination is particularly necessary in a matter such as
this where the collective b�siness interests of Pe[itioner and Calene are so intertwined that it
would impose nn undue burden on the bench for the Court to prepare interview questions
regarding the collective business interests, their relatiou to cach other and the terms of the
underlying Ope�ating Agreements/Articles of Incorporatioq em. related thereto (see busi�ess
compilation attached hereto aud ma�ked as Exhibit"C" which is not exhaostive of the Clouse
b�sinesses).
9. As a res�lt, Pe[itioner believes it is wholly appropria[e that Calene be called on
direct testimony to facilitate these questions as her ability to manage her financial resources (and
any impairments related the�eto) are relevant ro the determination of whether or not she is an
iucapacitated person consistent with 20 Pa. C.S. § 5501.
10. Petitioner also avcrs addressing the matter herein in advance of the Hearing
promotes judicial economy as opposed to Culene's objection being lodged for[he firs-t time in
open court which may delay the proceedings or cause them to be rescheduleci�
