ITEM I: I direct that all expenses of my last illness and funeral, including my grave marker and perpetual care, shall be paid from my residuary estate as soon as practicable after my decease as a part of the expense of the administration of my estate. ITEM II: I direct that all taxes that may be assessed in consequence of my death, of whatever nature and by whatever jurisdiction imposed, shall be paid from my residuary estate as a part of the expense of the administration of my estate, without apportionment. Allen, Executrix of the Estate of Dorothy M. Musser, deceased (herein referred to as "Executrix" and Beverly A. Williams, Cheryl M. Allen and Stacey N. Musser, residuary beneficiaries of the said estate (herein collectively referred to as "Beneficiaries"). In accordance with their desire that the administration of the Estate of Dorothy M. Musser be terminated without the additional expense and further delay of a formal court accounting, the parties hereto, in consideration of the mutual covenants herein expressed, and intending to be legally bound hereby, agree that: 1. The Estate of Dorothy M. Musser who died on March 18, 2001 is now in the process of administration, Letters Testamentary having been duly granted to Cheryl M. Allen by the Register of Wills of Cumberland County, Pennsylvania on April 5, 2001 at No. 2001- 00356. 2. Under provisions of the Decedent's Last Will dated April 22, 1998, the Decedent bequeathed the entire residue of her estate in three (3) equal shares with one share to her daughter, Beverly A. Williams, one share to her daughter, Cheryl M. Allen, and one share to her granddaughter, Stacy N. Musser. The Decedent further provided that each residuary beneficiary had to survive the Decedent by thirty (30) days. Each residuary beneficiary did survive the Decedent by thirty (30) days and the Executrix therefore proposes to distribute the residue of the estate as follows: a. One-third to Beverly A. Williams; and b. One-third to Cheryl M. Allen; and c. One-third to Stacy N. Musser. 3.
