PETITION FOR CITATION TO COMPEL APPLICATION
FOR LETTERS PURSUANT TO 20 PA. CONS. STAT. ANN. ~ 3155
The petition of Scott A. Morrison respectfully represents that:
1. Grant W. Morrison, Sr. died intestate, a resident of North Middleton Township, Cumberland
County, Pennsylvania, on November 29, 1999.
2. Decedent was survived by Elizabeth K. Morrison, his widow, and six children as follows: Emerson
A. Morrison, Grant W. Morrison, Jr., Lisa A. Hawkins, Scott A. Morrison, Susan E. Hurley, and Terrie
L. Eppley. No children predeceased the Decedent.
3. Decedent owned real property at the time of his death which petitioner is informed,
believes and, therefore, avers to be valued at approximately $475,000. The real estate is situate at 163
Old Gap Road, North Middleton Township, Cumberland County, Pennsylvania. He also owned personal
property of unestimated value.
4. Petitioner is Scott A. Morrison, of 130 Greenview Drive, Carlisle, Pennsylvania, and is the son of
the Decedent.
5. Neither the Decedent's widow nor any of his children have taken out letters of administration on
the Decedent's estate.
6. Copies of the renunciations of Grant W. Morrison, Jr. and Terrie L. Eppley, two of the Decedent's
children, are attached to this Petition as Exhibits "A" and "B."
WHEREFORE, petitioner requests that a citation be awarded pursuant to 20 Pa.Cons.Stat.Ann. S 3155
directed to Elizabeth K. Morrison, Widow, and Susan E. Hurley, Lisa A. Hawkins and Emerson A.
Morrison, children, to show cause why any of them should not apply for and take out letters of
administration on the Estate of Grant W. Morrison, Sr., Deceased, or failing this, to show cause why such
letters should not issue to petitioner.

Elizabeth K. Morrison, Emerson A. Morrison, Lisa A. Hawkins and Susan E. Hurley, by
their attorneys, Snelbaker, Brenneman & Spare, P. C., respond to the Petition For Citation as
follows:
1. Admitted in part; denied in part. It is admitted that Grant W. Morrison, Sf. died
November 29, 1999 a resident of North Middleton Township, Cumberland County,
Pennsylvania. It is denied that Grant W. Morrison, Sf. died intestate. To the contrary, he died
testate, having made and executed his last will and testament (the "Will") on April 16, 1999, a
true and correct copy of which is attached hereto and incorporated by reference herein as
"Exhibit A".
2. Admitted.
3. Admitted in part; denied in part. It is admitted that Decedent Grant W. Morrison, Sf.
owned real property at the time of his death located at 163 Old Gap Road, North Middleton
Township, Cumberland County, Pennsylvania as well as certain personal property. It is denied
that the real estate owned by the Decedent is valued at approximately $475,000. To the contrary,
the real estate was valued at $244,000 at thc time of Decedent's death and has a current market
value for purposes of assessment by Cumberland County of $243,380.00.

5. Admitted, with the qualification that letters of administration are inappropriate in
consideration of the existing Will of the Decedent, which Will Respondents intend to have
probated. Even in the absence of a will, Respondent Elizabeth K. Morrison would exercise her
right to have letters of administration issued to her pursuant to 20 Pa.C.S.A. 9 3155(b)(1)
and (2).
WHEREFORE, Respondents Elizabeth K. Morrison, Susan E. Hurley, Lisa A. Hawkins
and Emerson A. Morrison requests this Court to deny the Petition of Scott A. Morrison.
