Deceased, hereby declare under oath that he has fully and faithfully discharged the duties of his
office; that the foregoing First and Final Account is true and correct to the best of his knowledge
and information, and fully discloses all significant transactions occurring during the accounting
period; that all known claims against the estate have been paid in full; that, to his knowledge,
there are no claims now outstanding against the Estate; that all taxes presently due from the
estate have been paid other than listed in the proposed distribution; and that more than four

ESTATE SETTLEMENT AGREEMENT
RECEIPT AND RELEASE
THIS AGREEMENT, made this J5~ day of May, 2002, by and among:
RICHARD A. WALTON, Administrator of the Estate of Nancy J. Walton,

RICHARD A. WALTON, FRANKLIN IRVIN, LESLIE RHOADS, P~TI
JOHNSON, LINDA McCONNELL, WENDY DILLER, YVONNE HILBERT and SCOTT
IRVIN, beneficiaries by virtue of the Administration of the Estate of Gertrude E. ~sch.

WHEREAS, Nancy J. Walton died intestate on April 3, 2001; and
WHEREAS, on April 27, 2001, Letters of Administration were originally granted in the
Estate of Nancy J. Walton; and
WHEREAS, it is understood and agreed that all debts of the Estate of Nancy 1. Walton
be paid from the Estate of Nancy J. Walton, and which arrangement has been approved by the
five aforementioned beneficiaries; and
WHEREAS, the Administrator has proceeded with the administration of said Estate and
has prepared the Inheritance Tax Return and Inventory of Real and Personal Property with the
required Schedules attached thereto; and
WHEREAS, the parties hereto desire that the Administrator shall not be required to file
a formal accounting with the Orphans' Court of Cumberland County, Pennsylvania, and that the
net estate of the decedent shall be distributed without the necessity of filing said formal
accounting; and

WHEREAS, it is understood that in accordance with the First and Final Account,
attached hereto of each of the decedents, Richard Walton will be receiving a life estate interest in
the real property with Franklin Irvin and Leslie Rhoads each receiving a 1/3 interest in the real
property upon the death of Richard Walton.
NOW, THEREFORE, the parties hereto intending to be legally bound hereby, mutually
agree as follows:
1. The parties hereto, and each of them agree and acknowledge that they have fully and
carefully examined the Inheritance Tax Return and Inventory of Real and Personal Property with
the required Schedules attached thereto and the Schedule of Distribution relating thereto, and
find them to be true and correct, and acceptable to the parties hereto and each of them, and
further that each of them has received a copy of this Agreement and of the said Account and
Schedule of Distribution.
2. The parties hereto do hereby release, remise and forever discharge the Estate of Nancy
J. Walton, and Richard A. Walton, Administrator, the Estate of Nancy J. Walton, Deceased, and
Harry M. Baturin, individually, Madelaine N. Baturin, individually and the law firm of Baturin &
Baturin, and/or any of its individual members, attorneys for the Estate of Nancy 1. Walton of and
from all manner of acts, suits, claims, accounts, accountings, debts, dues and demands
whatsoever which they or any of them or their legal representatives or assigns may at any time
hereafter have, against the Administrator, and/or his attorneys, the said estates or the assets
thereof, from, for, touching or concerning any of the assets and property of the said estates and/or
any claim or interest thereto or therein, and the administration, management, collection, sale or
distribution of any of the said assets and for or on account of any money, interest income, assets
or proceeds out of same, from the time of the death of the said decedents to and including the
date of this Agreement and Release.
3. This instrument is a full and final Estate Settlement Agreement by and among the
parties hereto, both Fiduciary and individual, all of the same having been arrived at, concluded
and executed after a full and complete disclosure of the assets of the said Estates and the rights
of the parties therein and thereto and all of the parties hereto, and each of them, agrees to abide
by the terms hereof.
4. The parties hereto, and each of them, agree that they will at all times in the future an
whenever necessary, appropriate or convenient, make, execute and deliver to the said
Administrator and/or to the other party or persons, any and all instruments, documents,
conveyances, deeds, releases or other instruments of any kind necessary or convenient to carry
out the intention of this Agreement and/or to permit, assist and enable the Administrator to fulfill
his duties with reference to the said Estates and all of the assets thereof.
5. This Agreement constitutes the entire understanding among the parties hereto, and
each of them acknowledges that no representations or statements of any kind, written or oral,
have been made to them or any of them prior hereto by the Administrator or by any other person
or party upon his behalf.
6. This Agreement shall inure to the benefit of and shall be binding upon the parties
hereto, and each of them, their heirs, executors, administrators, successors and assigns.
7. This Agreement may be executed in multiple counterparts and, when as executed,
shall be binding upon all the parties, and their respective heirs, next-of-kin, personal
representatives and assigns.

BENEFICIARY INTEREST IN ESTATE
KNOWN ALL MEN BY THESE PRESENTS, that I, PATTI JOHNSON, a
beneficiary of the estate of Nancy J. Walton, deceased having died intestate on April 3,
2001, in Cumberland County. Richard A. Walton having been appointed as Voluntary
Administrator of said estate on April 27, 2001 by Order of the Orphan's Court of
Cumberland County No. 01-21-0423.
It having been agreed upon by all of the beneficiaries of the estate, that we would all
renounce our portion of the real property owned by the decedent, with the exception of Franklin
Irvin and Leslie Rhoads and wish for the property to be transferred to Richard A. Walton, the
decedent's husband and the Voluntary Administrator of said estate along with Franklin Irvin and
Leslie Rhoads.
It has been explained to me that I am entitled to a portion of the decedent's
estate and that by my singing this revocation, I forfeit my rights to said real property
portion of the estate. It is my intention to renounce said real property portion of the
estate.

RECEIPT AND RELEASE
THIS AGREEMENT, made this JStDday of May, 2002, by and among:
RICHARD A. WALTON, Administrator of the Estate of Nancy J. Wa1to~

RICHARD A. WALTON, FRANKLIN IRVIN, LESLIE RHOADS, P~TTI
JOHNSON, LINDA McCONNELL, WENDY DILLER, YVONNE HILBERT and SCOTT
IRVIN, beneficiaries by virtue of the Administration of the Estate of Gertrude E. Sersch.
W I I N E S. S. E I H:
WHEREAS, Nancy J. Walton died intestate on April 3, 2001; and
WHEREAS, on April 27, 2001, Letters of Administration were originally granted in the
Estate of Nancy J. Walton; and
WHEREAS, it is understood and agreed that all debts of the Estate of Nancy J. Walton
be paid from the Estate of Nancy J. Walton, and which arrangement has been approved by the
five aforementioned beneficiaries; and
WHEREAS, the Administrator has proceeded with the administration of said Estate and
has prepared the Inheritance Tax Return and Inventory of Real and Personal Property with the
required Schedules attached thereto; and
WHEREAS, the parties hereto desire that the Administrator shall not be required to file
a formal accounting with the Orphans' Court of Cumberland County, Pennsylvania, and that the
net estate of the decedent shall be distributed without the necessity of filing said formal
accounting; and
-
WHEREAS, it is understood that in accordance with the First and Final Account,
attached hereto of each of the decedents, Richard Walton will be receiving a life estate interest in
the real property with Franklin Irvin and Leslie Rhoads each receiving a 1/3 interest in the real
property upon the death of Richard Walton.
NOW, THEREFORE, the parties hereto intending to be legally bound hereby, mutually
agree as follows:
1. The parties hereto, and each of them agree and acknowledge that they have fully and
carefully examined the Inheritance Tax Return and Inventory of Real and Personal Property with
the required Schedules attached thereto and the Schedule of Distribution relating thereto, and
find them to be true and correct, and acceptable to the parties hereto and each of them, and
further that each of them has received a copy of this Agreement and of the said Account and
Schedule of Distribution.
2. The parties hereto do hereby release, remise and forever discharge the Estate of Nancy
J. Walton, and Richard A. Walton, Administrator, the Estate of Nancy J. Walton, Deceased, and
Harry M. Baturin, individually, Madelaine N. Baturin, individually and the law firm of Baturin &
Baturin, and/or any of its individual members, attorneys for the Estate of Nancy 1. Walton of and
from all manner of acts, suits, claims, accounts, accountings, debts, dues and demands
whatsoever which they or any of them or their legal representatives or assigns may at any time
hereafter have, against the Administrator, and/or his attorneys, the said estates or the assets
thereof, from, for, touching or concerning any of the assets and property of the said estates and/or
any claim or interest thereto or therein, and the administration, management, collection, sale or
distribution of any of the said assets and for or on account of any money, interest income, assets
or proceeds out of same, from the time of the death of the said decedents to and including the
.
date of this Agreement and Release.
3. This instrument is a full and final Estate Settlement Agreement by and among the
parties hereto, both Fiduciary and individual, all of the same having been arrived at, concluded
and executed after a full and complete disclosure of the assets of the said Estates and the rights
of the parties therein and thereto and all of the parties hereto, and each of them, agrees to abide
by the terms hereof.
4. The parties hereto, and each of them, agree that they will at all times in the future an
whenever necessary, appropriate or convenient, make, execute and deliver to the said
Administrator and! or to the other party or persons, any and all instruments, documents,
conveyances, deeds, releases or other instruments of any kind necessary or convenient to carry
out the intention of this Agreement and/or to permit, assist and enable the Administrator to fulfill
his duties with reference to the said Estates and all of the assets thereof.
5. This Agreement constitutes the entire understanding among the parties hereto, and
each of them acknowledges that no representations or statements of any kind, written or oral,
have been made to them or any of them prior hereto by the Administrator or by any other person
or party upon his behalf.
6. This Agreement shall inure to the benefit of and shall be binding upon the parties
hereto, and each of them, their heirs, executors, administrators, successors and assigns.
7. This Agreement may be executed in multiple counterparts and, when as executed,
shall be binding upon all the parties, and their respective heirs, next-of-kin, personal
representatives and assigns.

Enola is an older established neighborhood having a mix of residential and commercial uses within the same area.
This is typical of the area and would have no effect on marketability.
IMPROVEMENTS. Cont'd:
Unit #216 - This unit contains a living room, dining room, kitchen, 3 bedrooms and a full bath. Unit #214, according
to Mr. Walton this unit has an identical floor plan however, the positions of the second floor bathroom and rear
bedroom are reversed.

adjustment to sale price for each of the comps is used to calculate the weight each comp should have in a weighted
average calculation. As with any method, this technique is not perfect. However, it does a good job of giving more
weight to the most similar camps, while at the same time minimizing values near the extremes of the indicated value
range. The indicated weighted average is $76,700; which supports the conclusion of value stated within. Some

C-L Commercial Limited District
~361. Purpose. The purpose of the C-L Commercial Limited District is
to provide reasonable standards for the provision of uses of a light
commercial nature. The standards of this district are designed to minimize
the number of access roads from major thoroughfares, to minimize traffic
congestion, and to provide buffer yards and screen plantings where such
uses adjoin residential districts. (Ordinance 378-80, March -18, 1980,
Article XV, ~1501)
~362. Procedural Requirements. All. applications for permits,
pursuant to this Part shall be submitted to the Zoning Officer, who has the
option of submitting such applications to the Planning Commission or the
Township Commissioners for a recommendation. prior to issuing a permit. All
applications, other than for one- and two- family dwellings, shall be
reviewed by the Plan Review Board. (Ordinance 378-80, March 18, 1980,

~363. Permitted Uses. A building may be erected or used and a lot
may be used or occupied for any of the following purposes and no other.
All such uses shall be in conformity with the Performance Standards in the
part on General Regulations. [Part 19 of this ordinance]
1. Single-family detached dwellings in existence at the time of
adoption of this ordinance.
2. Conversion apartments meeting the requirements of Section 574(1)
to (4) and Part 21. The Building Official shall grant a building permit
when the above conditions are satisfied without hearing or approval of the
Board of Commissioners.
3. Branch banks, studios and professional offices, for professional
occupations.
4. Apartments, included within any apartment building containing not
less than thirty (30) apartments, retail shops, restaurants, beauty
parlors, barber shops, drug stores and bakeries provided that any baked
goods prepared on the premises are offered for sale only on the premises.
5. Retail shops, including shops selling groceries, meats, vegetables
and produce, sundries, and baked goods provided that any baked goods
prepared on the premises are offered for sale only on the premises.
6. Public utility facilities.
7. Drug stores and pharmacies, which may contain a soda fountain.
8. Office buildings, medical clinics, medical buildings, pharmacies
located in a medical clinic or medical building, where limited to the
dispensing of medicine, drugs, and prescriptions.

9. Dry cleaning and laundry establishments, provided that:
a. No dry cleaning or laundering is done on the premises. or
b. The laundry is a patron-operated service.
10. Signs - identification and business signs not exceeding four (4)
square feet for any residential use, or twenty (20) square feet for any
other permitted use. provided, however, that a neighborhood shopping center
under single ownership or management containing four (4) or more stores or
shops with a ground floor area not less than five thousand (5.000) square
feet may have one central identification ground. wall or roof sign not more
than one hundred (100) square feet in area, provided such sign does not
contain flashing or intermittently lighted lights or direct illumination
spilling over into any residential zone.
11. Service stations providing""gasoline and oil and minor services but
not including garaging or repairs.
12. Accessory use on the same lot with and customarily incidental to
any of the above permitted use.

5364. Conditional Use. The following conditional uses and no other
may be allowed or denied by the Township Board of Commissioners after
recommendation by the Planning Commission. pursuant to the express
standards and criteria set forth in Article XXIV. Section 2405. and Article
XXIII. [Part 24. Section 615. and Part 23 of this ordinance]
1. Mobile home parks.

5365. Building Height Limit. No building shall be erected to a
height in excess of forty (40) feet; provided, however. that the height
limit may be increased one foot for each additional foot that the width of
each yard exceeds the minimum required. Each and ~very yard shall exceed
the minimum by the number of feet proposed to be added to the maximum

5366. Area and Frontage Regulations.
1. Non-residential - the lot area shall be not less than ten thousand
(10.000) square feet and lot width shall be not less than one hundred (100)
feet at the building line.
2. Residential - for any lot served by both public water and public
sewer. the lot area shall be:
9.000 sq. ft. - Three (3) dwelling units
12,000 sq. ft. - Four (4) dwelling units
1.800 sq. ft. - Each additional permitted dwelling unit

shall not cover more than thirty percent (30%) of the area of such lot.

S369. Yard ReRUlations Where Not Adjacent to a Residential Zone.
1. Front Yard - no building shall be located closer than twenty-five
(25) feet to the front street line.
2. Side Yard of Interior Lots - the minimum side yard on interior
lots shall be not less than fiftee~ (lS) feet and the total width of the
two required side yards shall be not less than thirty-five (35) feet.
3. Side Yards of Corner Lots - the exterior side yard of a corner lot
shall be not less than twenty (20) feet.
4. Rear Yards - each main building shall have a rear yard not less
than twenty-five (25) feet in depth.

~370. Yard Regulations Where Adjacent to Residential Zone. Where the
lot boundary is adjacent to a residential zone, or fronts on a street the
opposite side of which is zoned Residential, the following regulations
shall be observed:
1. Front Yard - no building shall be located closer than twenty-five
(25) feet to the front street line, except that where the front street is
the zone boundary line of a residential zone. and the established building
setback line in the residential zone exceeds twenty-five (2S) feet in more
than fifty percent (50%) of the block frontage, the building setback line
in the residential zone shall be observed within the entire block of the
C-L Zone.
2. Side Yard - a side yard of not less than thirty (30) feet shall be
maintained between any main or accessory building and the adjacent
residential zone boundary line; otherwise the side yards shall be the same
as required in Section 369 above.
3. Rear Yard - a rear yard of not less than twenty (20) feet shall be
maintained between any main or accessory building and the adjacent
residential zone boundary line. Where an alley abuts the rear property
line, one-half (1/2) of its width shall be included in the required rear
yard.

less than six (6) feet in height and which shield may be extended along a

3. Front Yards - any required front yard shall be landscaped with any
combination of lawn, shrubs, flowers, and trees, and shall be maintained in
a neat and orderly manner. No use other than a front driveway to the front

impairinR any other section, subsection, sentence, clause,
phrase or provision of this Ordinanoe.
