FAMILY SETTLEMENT AGREEMENT
OF THE ELSIE H. WOODWARD ESTATE
THIS AGREEMENT, is made this "! day of �ebfem,l�� , 2015,based
upon the family circumstances outlined,is entered into with the Executrix by each beneficiary,from
the date of formalization of her separate Consent:
1. ELSIE H. WOODWARD died Testate on November 19, 2013.
2. Decedent's Will dated July 6, 1988, designated her husband, H. Vance Woodward,
as Executor.
3. H. Vance Woodward passed on April 18, 2003.
4. Decedent's Will dated July 6, 1988, appointed her son, V. Eugene Woodward, as
subsequent Executor.
5. Defendant's Will dated July 6, 1988,bequeathed her entire estate to her husband,H.
Vance Woodward.
6. Defendant's Will dated July 6, 1988, provided for, in the event her husband
predeceased her,her entire estate would be divided between her three(3)children,V.
EUGENE WOODWARD, DEBORAH W. RHOADS, and SUE A. SHEETS, as
beneficiaries.
7. The beneficiaries desire to forever settle and compromise any and all claims and
rights which they may possess, now or hereafter, in the Estate and to confirm their
acceptance of the distribution in satisfaction of the bequest contained in the
decedent's Last Will and Testament.
8. The beneficiaries wish to release the Executor and to indemnify him against any and
all claims that may be asserted against the Estate with the Executor after the date
hereof.
NOW,THEREFORE, in consideration of the foregoing and intending to be legally bound
hereby, jointly and severally, the beneficiaries do, for themselves, their heirs, personal
representatives, successors and assigns, agree as follows:
A. Represent and warrant that they have read and they understand this Agreement and
confirm that the facts set forth above are true and correct, to the best of their
knowledge, information and belief.
B. Declare that they have sufficient information to make an informed waiver of their
right to a formal accounting and without going through the estate process in order to
save probate fees
C. Release,remise, quitclaim and forever discharge the Executors,their heirs,personal
representatives, successors and assigns, from and against all claims that you, as
residuary beneficiaries of the Estate, had, now have, or may in the future have in
connection with the Estate.
D. If residuary beneficiaries agree to refund, on demand, all or any part of their
proportionate share of any aforesaid distribution, which has been determined by the
Executors, or by the Court, or by any court of competent jurisdiction, to have been
improperly made.
E Agree to indemnify and hold harmless the Executors, their heirs, personal
representatives, successors and assigns, from and against any and all claims, loss,
liability or damage (whether or not related to the negligence of the Executors) that
may hereafter be asserted against the Estate or against the Executors.
F. Agree to execute such additional documents as may be necessary to effectuate the
agreements set forth herein.
G. Acknowledge that this Agreement shall be governed by and construed in accordance
with the laws of the Commonwealth of Pennsylvania.
H. Consent to the Court exercising personal jurisdiction over them in any suit or action
arising out of the enforcement of this Agreement.
I. The following undersigned beneficiaries of the Last Will and Testament of ELSIE
H. WOODWARD, deceased, hereby consents to the Settlement Agreement and
acknowledges that they are about to receive from the Executor of the Estate of the
decedent, a final distribution of the bequest to us under the Last Will and
Testament of the decedent in the amount of$2,767.96.
IN WITNESS WHEREOF,the Executor and the beneficiaries have set their hands and seals
to be effective as of the date first above written.
